My son has lived with me for three years, the first 1 of which his father had custudy. His father made out temporary gardenship contract and I signed it. After about a year of which I still sent my ex child support, I stopped the child support and so he said he would make my son go back to live with him. So we went to court and my son (then 15 yrs old) talked to the judge and told him he didnt want to move back in with his father and the judge granted me full custudy. We'll now he wants to move back in with his father, I'm still paying on a loan for my retainer and my attorney. I don't think it is nessisary to go back to court and change custudy when he could just change his mind again. I've already said he could go live with his father and I wouldnt fight it. Can I make out a contract that is legal and binding for temporaty guardianship? If so how?

Sure you can. It's easy especially if we are talking about two parents.

Paperwork will vary from state to state, and you may check your state. As his bilogical father, he has the right to obtain medical care etc, there actually may not be a need for you to even do guardianship paperwork.

You already paid your attorney for a retained, call his office and ask him, if you need one, don't go to the attorney, just get a generic guardianship form, fill it out, notarize it and send him on his way.

For a temporary guardianship form and guidelines for its use, you can refer to the site listed below. The form is free of charge - just scroll to the bottom of the page.

All the best.
