I doubt that they would do so for murder, but I asking mainly about crimes that are less serious. If not, in what cases they do not offer plea bargaining? Thank you

The prosecutors will offer a plea agreement on any type of case. We recently had a murder case were the defendant was allowed to plea to 15 years for murder because the star witness had been arrested for an armed robbery. The were afraid when the witness's recent arrest became public a jury might let the guy go so they made the deal. Pleas are often worked because the case isn't air tight.

It has less to do with what the case is and more to do with how sure they are they can prove their case beyond a reasonable doubt and how much man-power will need to go into prosecuting the case. Obviously, very minor offenses more often get plea deals and repeat offenders are less likely to get plea deals. The whole system is up to an individual prosecutor's personal inclination.

It's possible to get a plea deal even in a murder trial, if you walk in and plead guilty to a lesser charge they will almost always make an offer, even if they have you on tape committing a crime.

Not always -- but often.

Most will often a reduction in sentence -- say 15 years instead of 20 -- even on murder -- the cost of a trial and the risk of acquittal are the main factors.

For example, say the prosecution is 75% sure they can get a conviction. They'll hedge their bet by offering you 75% of the setence rather than risking you walking away entirely.

They will only offer a plea deal if they don't think they have a solid case against you but don't think you know that.

As soon as they offer the deal, you should know that something is up.

Isn't there a DA in NY state who refuses any and all plea deals on DUI? I believe it got quite a bit if coverage in the NYT a while back.
