because the guy is homeless...and apparently he is a US citizen and not one of you are demanding he be put in jail, deported or hung from the rafters...can you say why? I fail to see any difference he is unlicensed, uninsured and still a criminal yet he got off scott free.

Cheyenne, deport him to England or wherever his ancestors came from.

It wasn't just a tragic accident either, he was a criminal by not having insurance or a driver's license. It is a CRIME and he should not have been on the road in the first place.

DJ, how was this man's rights violated? He didn't have a DRIVERS LICENSE nor did he HAVE INSURANCE, he was not licensed and not insured so where did his supposed rights get violated? It was the dead man's rights that were violated by not throwing this bum in jail. Oh and yes worse would have happened to an immigrant, legal or illegal. They would have been seperated from their children for months or years while in jail and then deported even if they were legally here.

Yes I checked the link and I also read your response where you said the man's rights were violated and I want to know how? He was illegally behind the wheel of a car and illegally driving that car on the road way so he was technically an illegal immigrant to the roadway since he wasn't supposed to be there in the first place except as a passenger and nope I never said that people should be allowed to drive without a license nor did anyone else, they argue they should be permitted to get insurance and have a driver's license a bit different from the way you are trying to portray it.

Ms Peapod, I am an American Indian so you tell me where would they deport me to? The US?

2007-08-01 14:13:38 · update #4

Mickey so you think it is ok to just give someone a ticket for killing someone? The man wasn't supposed to be behind the wheel and if he was suspended it was for a REASON. Also, you forget that this man who died has ZERO recourse nor does his family because the man had ZERO insurance.
I also want you to show me where anyone illegal has intentionally ran someone over. I don't think that is true and it is more than a bit dishonest on your part. Also, they aren't intentionally leaving their children, they are taken from work sometimes and not given the option of doing anything for the kids and ICE isn't obligated to check on the children either.

He was punished more severely than an illegal would have been for the same crime. I think his rights have been violated, that is, if citizens have the same rights as illegals, which apparently they don't.

Of course I don't condone his actions. But illegals get a pass, not citizens.

Did you even check the link? I'm not saying what he did was right, but illegals are fighting for the right to go about unlicensed and uninsured. AND WINNING!!! Don't you have a problem with that?

LOL! I just had to respond to your comment! An illegal did deliberately hit my car with his because he thought he had the right of way (Not so, and he left town before the court date--no insurance or license). He even told me so. Not that I expect you to believe me. And the judge and police officers confirmed that he was illegal and told me that I didn't have a chance in hell of collecting damages from him.

Who said he got a pass? I read the article and it did not say he got a pass. You are reading a lot into this. The article says

Reports say Bertoglio was legally walking in the crosswalk and obeying the crossing signal at Liberty Street and Center Street when he was struck and killed by the driver of a 1988 full-size Ford van just after 9 a.m. Tuesday.

Police say Shawn Hagen, 26, was operating his vehicle in compliance with the signal lights, but failed to yield to the pedestrian. He was turning too wide while making a left turn, according to reports.

Hagen was cited for failure to yield to a pedestrian in a crosswalk, for not having insurance and for driving with a suspended license.

The fact remains that he, in all liklihood, will be charged with manslaughter. The article indicates that he was operating his vehicle in compliance with the signal lights and it does not say he was drunk or impaired in any manner. Based on the facts presented one can only conclude that this was a tragic accident.

When I see postings on here about illegal aliens it is always that they were either drunk or running from the law...big difference. The point that is being made is simply this. If the illegal was not here the accident could not have happened. If the government would have just enforced the law the tragedy could have been averted.

So what is your point? You found an american citizen (and that is an assumption on your part) that had a traffic accident resulting in a death so therefore we must now and always allow illegal aliens to drive on our roads and we can't say anything when they kill someone?
I fail to see your logic

What a terrible thing to happen. The driver never should have been behind the wheel but he made a conscious decision to do so, & look what happened. The driver should lose his license for life & go to prison. It won't bring that man back but it's better than getting off scott free or did he?

Because,it was an accident and he was cited.
The illegals who come here sometimes even purposely hit American citizens. The illegals leave the scene where people are injured, sometimes they even leave their children to die just so they wont be caught and deported.

Well there is a difference between a suspended license and no license. and he was cited for failure to yield to pedestrian, driving with a suspended license and for no insurance.

So they where are you getting that he 'got off scott free'???

Or do you mean he should be charged with negligent homicide? Well I agree if that is what you are saying.
You just arent being very clear.

Where would he be deported to? He is an American citizen. You can't deport someone if they are a U.S citizen. Nowhere in that article did it say the guy was an illegal citizen.

EDIT: You can't deport someone to another country just because their ancestors came from that country. He is an American citizen. He CAN'T be deported.

This was an accident, and he was cited..... Obviously the prosecutor felt that It was not a wanton disregard for human life, which would be a felony. Deport a legal citizen to where?

i agree with you to a point, first he was or is a citizen, and by no means does that mean he should hv gotten off free, our judicial system is out of control, though it was a accident he still should have served time for his crime and he must pay for all troubles the rest of his life,,,

the difference is he is not illegal. here in the immigration section people are just looking to find wrongdoing by illegals. the fact remains without insurance or license,he had no right to be on the road. he should be punished
