I read the newspaper article about the soldiers raping and killing that 14 year old girl and her family and was wondering what Iraqi law says about that concerning the girl and the soldiers. I am discussing the stereotyping of males and females in not only America, but all over the world, and chose this article to talk about. In our country we would never publish the girl's name because she was a victim and because she was a child and yet her name is in print. I was wondering what Iraq law is concerning females when they are raped and murdered; if they are not murdered, are they considered unclean, like in our Old Testament Bible? I would really like to learn the culture more and have an open mind when it comes to other cultures, so please, no answers with attitude, just ones with respect. Thank you--

First off...

Iraq is a secular nation. There are no Iraq-specific religious laws.

Bismillahi Rahmani Rahim - In the Name of Allah, the Beneficent, the Merciful

Hello. Well, you have to draw a line of distinction between Islamic law and Iraqi law. They are two different things. The Iraqi government is not a pure Islamic government so I don't know how they deal legally with such an issue.

In Islam, when the horrible crime of rape occurs, the victim is held blameless. Certainly she should be given her privacy in order to keep from traumatizing her further. There should be no stigma attached to a rape victim, because she is innocent and had nothing to do with the crime. Unfortunately, in the "real world" of culture, that is not always the case. Indeed, it is noble for a man to marry a woman who was victimized in this way (after time has passed and she has recovered physically and mentally) in order to help her to have a normal life. Also, if she were to become pregnant by the rape, then she would have the option of either carrying the baby to term, or, if it would cause undue mental harm to her, of aborting, as she might suffer greatly to have this reminder of her victimization.

Islam is a religion of common sense and it would not seek to further victimize a girl or woman in this condition. It is a sad truth, though, the culture has overtaken religion and the reality of "honor killings" and such is a shame on every Muslim who allows such a thing to happen. And Allah knows best.

Fi Aman Allah,

If you are writing a college paper, you need better sources than yahoo answers. Your college undoubtedly subscribes to online databases that would have articles from journals and newspapers, etc. I'm a college librarian: please go to your college library and the librarians there can help you get good sources for your paper.
