That would be illegal. Consent by someone is given at 18 years old. The *new* age of consent of 16 is with parental consent. Which means the 23 year old would have to ask the 16 year old's parents to have sexual relations...GOOD LUCK!
And what if they tell the 23 year old yes, then call the police and lie...the police would undoubtably believe the parents.
If the 23 year old ws within 36 months of the 16 year old...i.e. 19 yo or younger, then it would be legal.

In my state (Alabama) it's illegal. The age of consent is 16, but there is an age-gap rule too. The 16 year old can have sex with someone who is two years older, any older than that, it's illegal.

In Michigan, I know it is illegal for an adult to have sex with a minor. The age of consent is 16, but both parties have to be under the age of 18. If one is older, then it is considered statutory rape and you are in deep s*&t.

Usually the age of consent is 16 within four years, meaning the person has to be 20 or under. So yes, that's illegal.

The 16 year old is out of control and needs to grow up.
The 23 year old is a pedophile (in my opinion) and needs to be in jail.

If the age of consent is 16, then it is not statutory rape.
Whether it was legal or not depends on whether any other laws might be broken (forced rape, having sex in public, etc.)
