he applied for ssi about two or three years ago he has appealed and i don't know the status right now cause he hasn't seen my kids for four months ,when i put him on child support, will my my children get any money? he has epilepsy and is depressed been in and out of mental hospitals and is going to outpatient.he used to get ssi back in 1997 he started working they found out and took it away,he paid them back.about 04 or 05 he quit his job and wants check back,will my kids get any medical or a check from ssi?

Well, lets start with the Ex. It is going to be real hard for him to get on SSI in the first place if he has already had a fraud case against him. Even if he did pay it back. He has his work cut out for him to convince them he is not a fraud.

As for your kids, I would call SSI and find out exactly where they stand. But I don't think they can collect so long as your EX is alive.

Nor can you exact child support from his SSI. If he gets on it - you are pretty much out of luck.

If he qualifies for Social Security Disability, your children will get regular checks, almost as if he were dead. They'll get back money, too, for the months he's been unable to work while the SSA was figuring this out.

Call your Social Security Office and have them work on this with you. You'll have to account for what you did with the money once a year, but it's a really short form; if you say that you spent it on the children's needs, they believe you.

Not child support per say,.but if he gets disability the child will get a check also ,it will be a direct deposit to your bank and as long as the child is in school he or she will get a check,.And the checks should continue until the child is done with college,.....If there is no college it will stop at age 18,.as far as medical you may have to foot the bill .....unless the child lives with the father.

SSDI is non taxable income. child support is never taken from this type of income resource.

I think that SSI provides for extra money for a dependent child, however. your ex needs to add the child's name as a dependent on his application form(s).

an attorney would probably know more about this?

I know jail inmates who pay child support, so I believe the state would send you a small portion of his disability check. it wouldn't be much, but they would may take it out his check and send it directly to you.
