I was parked in a no park zone and expect a ticket for that, however, the sheriff "accident investigator" keeps calling me for information and it sounds to me like they want to make a case against me out of this accident from around the beginning of the 07 year. I slid off the road and hit ice, dented the front of my car and busting the headlight + fixture. At first, the sheriff wanted to meet me to fill out an accident report, but I told him I have the forms from online as well as the mailing address so I would take care of it myself. That prompted him to come forward and basically tell me he doesn't believe me because the car is not rusted and coroded where the damage is. Also, while we were on the phone, he told me he thought I was lying when I asked him. That upsets me but oh well.

Can I get in legal trouble for an accident from 6-7 months ago that only involved my car?

Because the investigator had made mention of the damage, and lack of rust, it appears that they may be considering your case a fraudulent report, and/or a possible hit, and run accident. You should have cooperated right from the beginning.

In Texas you can get into trouble for that sure enough. I slid off of a road in heavy rain, no one else was involved and I was going twenty miles per hour slower than the posted limit. The trailer I was towing turned over so I called a wrecker service to come and help me get out of the ditch and turn the trailer back onto its wheels. A sheriff deputy was also dispatched to make an accident report and I got a ticket for failing to control speed in inclement weather. I asked the deputy why I got a ticket when there were no victims and he said that if I had been traveling at five miles per hour with a priest as a witness I still would have recieved a ticket for not controlling my speed due to bad weather. In other words, if you have a wreck due to any weather condition then you probably shouldn't have been driving. I think it is just a revenue source for the county and state. In your case someone was probably hit and they are trying to blame someone and the cops are attempting to tie you to it. You may need legal counsel. Good luck.

In CA....If the damage amounted to over $500 worth, it needs to be reported to the DMV.

On a side, not...No. I can't imagine you would be.

You said that he questioned the time of the accident by the evidence (rust.) I had the same thing happen to me.

Someone was hit and run about the same time I was hit. An AH cop saw my car and thought I was the hit and run guy, so I was hauled in and grilled about it. He was being a total prick. I told him I filed a report, but he couldn't find it so he kept pushing me (2 hours). I kept telling him to **** off. Finally one of his underlings found the report so he apologized. I filed a complaint.

By the way, this was the Security Forces in the Air Force a long time ago, not real cops.

From what your saying, it sounds like they are investigating you as a suspect in some sort of hit and run case.

You need to meet with them and be truthful about everything and get this cleared up. If it is a hit and run case, its a criminal offense in most areas. And in most places the statute of limitations for prosecution would be from 3 to 7 years.
