If i have never had any arrest or conviction record for any type of drug can the mother of my child make me take a drug test?
Seems kind of an invasion of privacy, there are no grounds for it whatsoever.
I do smoke the occasional joint at a party....never, ever when my child is around.

Dunno if i made it clear enough....im 29 years old and i have NEVER been in trouble with the law in ANY way. Now why must i subject myself to any sort of test....on what grounds?
Silly her because if they did a hair strand test on her, they would find alot more than pot....

The mother can request that the court order a drug test, absolutely.
If you have never been in trouble with the law, I fail to see why the court would ask for it, unless the state you live in does it routinely.
If for some reason the court does do it routinely, then they also have the ability to do random drug testing. I strongly suggest you cut out even the occassional joint.....

Unfortunately it is well within the rights of the family courts to insist on drug tests- especially when they're trying to decide what would be best for your child. If your ex has reason to believe you need a drug test, she knows more about what you do when you go out than she really needs to, so I'd avoid smoking it at all- at least for a few years while the family court is involved. Also, if you are involved in your child's life, if it's ever found out that you smoke, however occasionally, it could be grounds to have your child removed permanently- and a drug insinuation can ensure that the most you get can keep you from getting more than supervised visitation with your child (and trust me, it's uncomfortable as can be having your ex "babysitting" your interaction with your child!)

I am sure she could petition the court, but she would probably have to prove the need for one to the judge. I am sure the circumstances around the arrest or conviction would be taken into account especially how recent it occurred. I you are concerned, maybe you should lay of the occasional joint just for good measure.

Welcome to family court. If your ex has a suspicion that you are doing drugs at ANY time, they can ask for one. If the judge orders it, then you have to do it or suffer whatever consequences he/she sets forth. My advice, lay off the pot.

she can petition the court to have you drug tested if she has a valid reason and they make you comply if the courts see fit and when it comes to kids chances are they will ask for it....

Do they attempt...definite...will he be examined...they might, they did me...does he might desire to prepare? it would make existence a lot much less difficult if he can bypass...good luck....oops my turn to vape
