I accidentally left my cell phone in a bathroom at a restaurant. I left the restaurant after using the bathroom. I was only about half a block away when I realized that I didn't have my phone. I quickly went back and someone was going into the bathroom (only one person can go in at a time). When the lady came out, I asked her if she had seen a phone, she said no and showed me that she had no purse or anything where she could have put it. The manager of the restaurant went to look at the video and I saw that a girl went to the bathroom soon after I came out. I asked her if she had my cell phone and she said she didn't. In the video I can see that she went to the bathroom with her pocket book and she went to the bathroom right after me. My cell phone is a blackberry so it's pretty big, she must have seen it. I didn't want to insist on asking her because I knew she was lying to me. The fact that my phone is a nextel doesn't help either because you can easily replace the sim card.

Should I have called the cops? I know she kept it and was too embarrassed to admit it. I didn't want to make a scene but in retrospect maybe I should have.

oh, I left her a note with my friend's number just in case she changes her mind.

Of course I called the phone, she turned it off....and insurance won't replace my sim card with ALL my important information.

OMG u poor thing. My cell has my life in it as I'm sure ur blackberry did. Stealing is such a violation, I hate it. I had someone at a Rite-Aid drug store change the battery on my electronic planner once & she lost everything. You'll some day remember this thing that u miss then that thing but as with me, you'll never remember everything lost which is kind of a blessing. I always pray to Saint Anthony, patron saint of lost things and he never fails me...never. The Lord gave him this power so let's both ask him. Let me know by email, k?

It's always unfortunate when things like this that could have been avoided, happen. You really have no one to blame but yourself. That said, I would have asked the person like you did and then maybe ask for assistance from the manager. The manager should have done a bit more to ask the other customers at his restaurant. If it was on video and they were still there when you came back, the manager could have taken the situation in his own hands and insisted that the woman show her purse. The fact that he didn't suggests that he is not fit to be in a management position or maybe he knows something you don't...

I think you could have just turned to the manager and calmly commented: "Ok, thank you for your help. I'll just leave this to the police." Then borrow a friends cell phone and make the call. Most thieves are also cowards, and that might have just been enough to get her to fork it over to you.
I sympathize with you, that's an expensive loss. I just lost a $35 umbrella I've had for 15 years, and I'm heart broken. It was taken right under my nose!

File a report with the police for insurance purposes.
Contact your phone company to cut off your phone, they also will take the precaution that your phones serial number will be flagged and not be reinstalled without your express permission.

In the Land of the Free is one not innocent until PROVEN guilty? This is the kind of attitude that allows Guantanamo Bay to exist.

You should have put insurance on your phone. It never hurts to file a report though. They may be nice enough to help you out.
-If all else fails eat a tray of brownies and make sure to keep your phone by you all tha time.

I think I would have tried calling the number.
I don't think I would have tried to insist that she must have the phone.
