He needs to take the summons & complaint to Allstate immediately so that they can respond (I think there is a 20 day limit on the summons & complaint to answer it). They were the insurer at the time of the accident. I hope he reported it to them at the time so they could investigate the accident & determine fault. If he did not & this is the first notification, it could jeopardize the claim. Did the other party claim damages to his vehicle? Did Allstate pay for the damages?

He will have to contact Allstate because the date of the accident was during the period that he was insured with Allstate.

The insurance company of record at the time of loss is the insurance company that handles the claim, and that is AllState. It is chintzy to change companies just after an accident by the way. You expect the company to stand by you if needed, but show no loyalty afterward? In my opinion it is dirty pool to switch companies in the first year after any claim or possible claim. But, it is legal.

you weren't quite harmed via him not having insurance. on account which you have been at fault, it quite does not count number if he had insurance. You brought about injury. yet your insurance enterprise might desire to sue him for a million/2 the fee. He do not have been on the line. yet, it is extremely not your undertaking. That guy became attempting to play poker with you hoping which you does not call the police. you probably did the main suitable element to call the police. it extremely is going to later be desperate that he did not have insurance and his motor vehicle registration would be cancelled, he gets a hefty wonderful and gets SR22 insurance (high priced sort). His probability to sue you in case you probably did not have insurance is dumb. he's making a stupid fact that in case you have insurance, you does not be sued, yet once you probably did not you would be sued. what's the factor? in case you want a splash revenge, you will possibly be able to desire to take your police record and a reproduction of the letter from his insurance enterprise and permit the police be conscious of. yet they probably already be conscious of. maximum insurance companies are required via state regulation to tell the state if insurance has been cancelled or lapsed or in any different case grow to be invalid.
