If someone has been "admitted," they are entitled to due process. Many are EWI- "entered without inspection," a technical term for INS that describes someone who dashed across the border somewhere along the 2500 miles with Mexico.

The US Constitution's Bill of Rights provides that "all persons" shall be protected, not merely those who are at this moment legal in the USA.

A "tourist" who has stayed beyond the admission period is out of status. But he entered and was admitted, thus he is entitled to due process as are you and I.

To deny constitutional protection to a class of persons as large as "illegals" would require a modification of the Constitution. And be careful what you ask for- if you were to change the Constitution to deny protection to "illegals," who's to say the class of people to which YOU belong might not be next?

So I can go out and freely murder, rape and rob them?

Of course not all people inside of a nation are protected by and subject to the laws of that nation, unless they have diplomatic immunity.

So illegal aliens are subject to be protected by our laws. That doesn't mean we have to pay for their health care, give them driver licenses, or let them run for political office. They are here illegally and in violation of the law and if captured they will be deported.

But, the proof is there; we need their labor. Farmers are having crops go unpicked because they can't find an American to pick the crops for $20/hour. They can find an illegal alien or someone on a green card that is willing to do it for 10th the money, and be happy to get the job. By not instituting a liberal green card policy to let these people work legally we are shooting ourselves in our own economic foot.

If the illegal aliens had a choice besides being illegal then a lot of them would take it. The choice is to wait in a long line, fill out forms, wait for years, and then be denied entry. It is stupid and the green card process should be streamlined. Do that and we can curb our illegal alien problem and it will help to keep our border secure because the only people trying to illegally cross it will be drug smugglers, criminals and terrorists.

I think that a better idea would be to have any public entity such as schools, libraries, and hospitals have everyone show that they are here legally, I would not deny help, in most cases but when illegals know that documents will not deny them some benefits, but they will have to admit they are illegal, it might make the less likely to come. I would also make those that are having babies at the expense of the American, sign a document that says that not only are they here illegal, but acknowledge that they have no funds to ever pay for the bill. I would make it a felony to give a false name or address when availing one of any public service, knowing that you have no intention of paying

The Constitution wasn't written with illegals in mind. It has been the likes of the ACLU, and human rights groups that have twisted that around on Americans through the courts

Well there are basics in which all should be given. If I saw someone get run over by a car for instance I wouldnt stop helping him because they were an illegal.

However some of the legal system has been 'interpreted' way out of line by judges who wanted to make a name for themselves and set bad precedents.

laws are in place to protect us.. unfortunately some view them as us and they arnt they broke the laws to get here

i agree there needs to be a reform of laws but they should not include granting access to 12-20,0000 illegal immigrants but then on the other hand it will be a all out civil war on American soil and i think the vast majority are ready to take that into effect unfortunately i don't want to loose family and friends over this but then on the other hand if we don't do some thing will there be any thing left to leave for your children or grand children in the future ?

Yes, one would think so. When one of our citizens breaks a federal law they can be deprived of their constitutional rights. But if an illegal breaks a federal law, they suddenly get constitutional rights. Is this a great government we have or what?

"To the extent of the law." Our laws come, to a large extent, from our Constitution. That's why. Our nation is powerful enough to take care of a problem without ignoring our own Constitution to do it.

Why the constitution have to protect them? Everytime one of those cross the border or stay after their time, they are spitting at the goverment and the constitution that creat it!
Talking about human rights? That means that if they are deported we are violating their humans rights? Why? Because they are sad?

If you want to be protected by any constitution of any country the first thing you have to do is to respect the country laws!

Sadly, americans are to nice or to dumb,but today everybody is deciding how to run this goverment, but not americans!
