i work 50-60 hours every week so i dont get over time because im on salery. plus i worked over 40hrs that week even missin that day

no they cannot deduct your pay especially if you are taking your daughter to the hospital

Yes, they can deduct the day from your pay unless you used sick time or other paid leave time.

That said, just because the employer puts you on "salary" doesn't mean that they aren't legally obligated to pay you overtime pay of time and a half for hours over 40 in a week. It depends on your job responsibilities and your annual pay. Since you don't say what you do for a living and how much you are paid, it isn't possible to tell you whether you should be covered - look at the links from http://www.dol.gov/dol/topic/wages/overtimepay.htm to get more info. Basically, unless you are in certain professional jobs, or have management responsibilities, they still have to pay you overtime even if you are normally salaried. This is federal US law.

If your usual workweek is 50-60 hours and they still deducted for a day off, that was pretty tacky of them. You could point out that you still worked 40 hours that week even with the day off.

That's up to your employer. Simply being on salary does not mean that your pay cannot be docked for not going to work, regardless of the reason.

Most employers have a vacation or PTO plan that would allow you to take the day off for personal reasons and still be paid.

They would be fully within their rights to dock your pay if you did not show up at work and did not opt to take a vacation day or personal day.

What does your contract or work agreement say? Do you get any personal days or sick days?

If you don't, it sounds like a crappy job! By any chance, do you work in the food service industry? Sounds like my husband's old job. He was a restaurtant general manager.
