ok i live in texas. my boyfriend borrowed my car to go to work. got in a minor accident where the worst damage was a long scratch. info was exchanged the thing is he has no d.l and so he's not insured, but my car is, full coverage. ok so info was exchanged and he left before cops got there because the guy said he(my boyfriend) could go cause he was late for work...i know i made a dumb decision but what happens now? the cop came by my house and said my car could get impounded and he would go to jail and i will get sued. is that true in most instances? thanks for your help. and i dont need comments on how bad a decision that was i already know....thanks

you have insurance, you are okay, unless you insurance policy says otherwise, your boyfriend is out of luck. Your car is unlikely to get impounded. You are okay. Your insurance will cover the "minor damage" that is the point of insurance, use it. It was not a hit and run, it was just a guy driving without a license with your permission.

You need to ask your agent. it's highly likely, especially if he lives with you, that your policy won't pay AT ALL. That means, you'll be writing a check, personally, for the damage to your car, AND the other car. So, you don't KNOW if your car is insured right now. At the very least, you can expect that you'll be required to sign an operator exclusion form - but if I were you, I'd expect that your insruance company will cancel your auto insurance for letting a non licensed person drive.

Although it's possible that your car will be impounded, it's not likely. If you don't step up to the plate and write a check for all the damages, though, you WILL get sued, and you'll lose, and your wages can be garnished forever until the damages are paid.

I would be surprised if he was given jail time, but I'd expect he'd have a hefty fine.

Call your agent. They're going to find out about this anyway, and they'll help you minimize the damage.

Well, your boyfriend should go to jail for leaving the scene of an accident. He won't, but he needs to reconcile with the police. The police said that you would go to jail because they can't really verify who was in the car. And the state will do some very stupid things, so you may have to jump through some hurdles with the state to reconcile the situation. For the most part, however, they have better things to do than put you in jail. They are much more likely to suspend your liscence.

Since I am not familiar with Texas you need to call your agent. I assure you that they have seen this happen before and they can guide you through what to do. Or you may want to call a friend that's an agent.

Now, as far as your insurance is concerned, yeah, your rate may go up a little bit. But, generally it's your car, and if you pay collision, then anyone can drive it unless the insurance company knows you are not the primary driver. For example, your dad can't insure his kid brother at the rate he would get. But, if someone happens to drive your car one time and he gets in an accident. No biggie. You will pay a deductible, but you are covered unless your policy strictly forbids anyone but you from driving the car. That is highly unlikely.

And as far as you getting sued? Well, it's going to be your boyfriend's word against the other driver's. The other driver would have to be extremely deviant to tell your boyfriend that he could go and then sue him for leaving the scene of the accident. And furthermore, if it's just a scratch, what is he going to be able to sue for that the insurance company doesn't already cover? So, you may get sued, but the insurance company is on your side, Allstate or not. That's what insurance is for.

The cop is blowing a lot of smoke at you, and you shouldn't get scared. He's just being a jerk, and he's required by law to say things, but the chances of you either going to jail, getting sued, or losing coverage are very slim. If he killed somebody it would be different. Again, call your agent or your adjuster if it's like Geico or something, explain the situation. They will help you.

Something about your story isn't adding up -- why would a cop come by your house and tell you you could get sued, etc? The only illegal thing your boyfriend did was drive without a license and leave the scene providing the cops were even called. Your insurance follows the car, not YOU, so it was legally insured -- (or WAS it?) If he were to be caught driving with a suspended license then yes, the car goes to the impound lot and he gets a trip to the station house. One last rub -- if his license IS suspended then giving him permission to drive yopur car MAY void your insurance coverage. Texas insurance laws are in a world of their own so be prepared. If this story is even real (which I have my doubts about..) then call your insurer NOW and spill the whole story.

I would bet that your car was insured for a legal and authorized driver,so there goes the insurance out the proverbial window.thus making you responsible for any damage your car caused.Since the police were called,your boyfriend is guilty of not only driving without a license,but also leaving the scene.I doubt if your car will be impounded.As long as you pay for the damage to the other car you should be OK.I hope you did not admit that you knew your boyfriend had no drivers license.If you did know,then you are guilty of aiding in the commission of a crime.

Alright he is a dead beat and cannot afford a car himself! Girl you must set your sights higher. Borrowed your car and no drivers license? Please Hire a private investigator and find out just what this person has been into to loose drivers license and driving privilege. You can do better!

It's true...and your insurance won't cover this because he didn't have a license and you were stupid enough to let him drive. Your car could very well be impounded as well. He deserves jail for not having insurance and a license...was it revoked? I bet it was.
