Usually International laws are made by conventions formed by the countries wishing to take part which doesn't mean all countries are bound if they are not signatories.The Geneva Convention is one instance there are also International laws on Air Travel and The International rules for the prevention of collisions on sea.Usually the court involved would charge something like war crimes and cite the Geneva convention as the the rules for correct behaviour or in a collision at sea the rules would be used to show that someone was in the wrong by International law but the charges would be under local legislation such as manslaughter or damage caused by negligence.The recent war crimes trials at The Hague of Serbian war criminals are an example.

Actually, there is no such thing as international law. At best, international law is what the countries involved agree to follow. There is, by definition, no lawmaking body with the authority to pass any truly international law.
