Your question is not very complete, it is also very disturbing!
My daughter has been practicing orthodontics for 14 years and in all her time there has never been someone that broke their ankle due to "pain" caused by orthodontic surgery, unless you OD on some pain meds! Are you just pissed because she is a blonde chic? What is your point? Almost all orthodontic procedures have a fair amount of "pain". Most people are able to handle it, if yours hurt 5 hours after "surgery", which orthodontist do not do, if there is surgery required for removal of teeth, they are sent to a maxioffac. doctor. I would say if you tried to sue her, you would loose due to pure stupidity...sorry

if the orthodontist thinks your child is not cleaning her teeth well enough, but proceeds with braces anyways--that is malpractice. He can refuse treatment to anybody for any reason. A lawyer would most likely not take this case because there would be no way to compel him or win any money because he did not do anything harmful.

I don't get it.
Orthodontal work DOES hurt.
Her age and hair color shouldn't matter, nor should the fact that you had to go to the ER. That doesn't matter.
Braces hurt.
Sorry, but it's the truth. If you didn't think there would be any pain, then you are VERY gulliable.

Your teeth are supposed to hurt after an appointment. Even up to weeks. That means they are working.

Sure go on ahead. If I were the judge, I would probably dismiss the case.
