I have a huge family crisis because of a Christian!!!?

Question

My highschool was just being finished up from remodeling over the summer and the gym's inside
was being painted with our school colors and decorations, etc.
Lots of the kids who are going into the senior class next month volunteered to paint it and my brother was one.
and this little, Christian, witch, Adria just happens to also be one of them.
Late Friday afternoon, he and she were the only two left.
and she claimed that he raped her.
We have no reason to suspect this is true because he came home just like any normal day, he's been doing this for two days out of the week
for the past month, and nothing seemed out of place about him or anything.
Now, she was taken to the hospital, and was found with semen in her that matched my brother's blood type.
However, the thing ppl don't know is, she was dating my first cousin who was a senior off and on at the same time
and his family is Christian. And she completely denied this to the doctors because they asked her if she was seeing anyone and she lied and
said she wasn't.
you know the type..blonde, gorgeous, rich daddy, loooveeesss Jesus yet a total s l u t who can't keep her legs closed
and a b i t c h to everyone? Yet she gets away with it because she's so active in the church, and leads the youth group bible study.
So no one believes you who doesn't go to your school and everyone who does is already friends with her and they're just the same?
Her parents are just as bad, they were somehow able to get intelligent Design taught in our school, which wasn't too hard because the entire school board is either
Orthodox Christian or Catholic.
My brother would honestly never do anything like this!! He is the sweetest guy. He
helps out at the homeless shelter, and sometimes does food drives for my school.
And my parents and I, believe this was some type of ploy against my family because we're Atheists.
She has never been nice to me OR my brother. My brother really liked her one time and asked her out
and she told him to spazz off, because she wouldn't date someone who was stupid enough to sell their soul or some stupid crap.
And that really hurt his feelings.
He is only 17 and we don't think it's fair that she said that just because my brother is an Atheist.
What should we do?

Why would she lie? It creates as many problems for her (if not more) than it does for your brother. I would have to believe that your brother raped her. How the hell would you know how slutty she is? By rumor? I think not. How dare you blame the victim. Now I respect that it is your job to stand by your brother (I would stand by mine), but this calling the girl a slut is just disgusting and makes me think your brother did it even more.

I'm sorry to hear your family is in the middle of this. There are no easy ways out.

The only certain circumstances that you have relayed are that Adria and your brother were alone, and that semen matching his blood type was present on her.

These neither point towards rape nor dismiss it outright. Some kind of sexual activity happened with her and a male - and it's likely that further testing will either exhonerate your brother or fail to do so.

Then there's the intent part. If it is only her story against his, it may not go to trial. Note that I have found this infuriating in the past when friends of mine have reported rape but never received trial because the local prosecutors did not have enough to press a trial.

Either way, you and your family may find it helpful to talk with a counselor (independent of the school) to help all of you work through the feelings of hurt and rage you must dealing with. Getting past these feelings will help you to be more fully present for your brother, which is what he needs. If a rape has occurred, it is terrible enough without having anger tear a family apart.

Your anger at her popularity is understandable. I never enjoyed being at the tail end of that lever. People like her don't make it far in life before they discover that popularity is entirely transitory and disappears in importance when real skill comes out.

If you don't mind, I'll keep you in my prayers, for the exhoneration of the innocent. You might personally benefit from meditating to help you confront your feelings and keep your cool when classes resume. High school kids are awful by nature, and it is not fair that they will pick on you for this, but they will.

Did the semen only match his blood type? If you really believe he's innocent maybe he should give a DNA sample so they can see if it matches exactly. Tell the police about her dating your cousin if they come to question your brother. BTW I feel for you for the way your family is treated for being atheist. It shocks me how badly atheists are treated in America by supposedly peaceful Christians. Maybe you should go to a less religious school? Seeing as they teach Intelligent Design it can't be that great an educational facility.

Remove everything from your mind except the facts. Forget what kind of person you think she is and what kind of person you think he is. All accused are innocent until proven guilty. If the evidence collected from the plaintiff yields DNA that matches your brother, then he had sex with her. Then it's up to her and the prosecutor to prove that your brother did so forcefully.

If the evidence is there and he is convicted then you have to accept the verdict. However, the burden of proof is on her. There would have to be corroborating evidence to prove that there was force involved. It's possible it may not even go to court. But if it does and he is convicted then you will have a sex offender for a brother.

If the DNA matched, he probably did it. Rape is a common crime. You may not like her, but that doesn't give your brother the excuse to rape her. Of course your breother is going to act normal. Did you think you's aks him how his day was and He's say, "Just fine. By the way I raped this girl."?

If she wasn't raped, she wouldn't have gone through the whole ordeal at the hospital and with the police.

The fact that you and your brother think she is a slut makes me think he is guilty. It shows the old "she asked for it" mentality.

The DNA evidence will reveal whether the semen is your brother's, your cousin's, or neither. If the girl has falsely accused your brother, it's a terrible thing she's done. If her accusation is true, however, then your brother deserves to go to jail for a long time.

First of all and most important: calm down so that you and your family can manage to scrap off the bullshit from this and see it for what it actually is. Your brother needs a lawyer asap. SAY NOTHING ABOUT THIS INCIDENT to friends, neighbors, even to those who you trust outside of your immediate family. SAY NOTHING. It looks like there's gonna be a criminal trial involved here and so you need to realize that ANYTHING you are heard said, could be turned around on you, taken out of context, and then used against your family and esspecially your brother.
If I'm not mistaken, semen types are just like blood types. A whole lot of other males are gonna have the same semen type. The burden is on her lawyers to PROVE non-consensual sexual intercourse took place.
One thing your brother has to be sure to NOT DO is if he did have consensual sex with her, he needs to say that upfront. He should not lie about anything at all, or else he'll be in loads more trouble. Rape is not like getting caught in the gym with a ciggarette; we are talking about his entire future going down the drain in jail. Tell him to keep his MOUTH SHUT except to a lawyer, period. I cannot stress that enough.

The two of them were alone, which gave him ample time to assault the girl. His semen type was inside her; this is not looking all too peachy, but not all is lost.
Its her word against his that it was rape and not consensual. How long ago did the girl have sex with your cousin? I assume they found fresh semen inside her, and I also assume the girl showers so the semen is probably not your cousins.
But you know that when they do a rape kit, they also study the vaginal walls to see if the sex was forced - they can tell from bruising.
Also, if your brother raped her, I assume she would have fought back: does she have evidence like his skin and blood under her fingernails? Does she have bruises where he held her down? Theres alot more in evidence than just a semen type that will play out here. Its important that your brother understand that he should tell the absolute truth if they did have sex, because they will know he's lying if he does lie.

As far as it being a predominately Christian School and Community, I can't help but wonder why your family stands out so much as to be hated to the point that you would think its a "plot" against you. Have you stirred up trouble in the past at School? Are you actively insulting others beliefs? It would serve you well to realize that a Christian is not going to stand by for very long if God is continually being mocked and ridiculed. So if you guys have been doing that sort of thing then don't be so surprized
when folks retaliate. But this does NOT sound like a plot against an athiest family.
It sounds like one spoiled little brat's intention to discredit your brother and get him into big trouble. What she did not figure into this is that she's gonna be put under a scrutiny that she probably doesn't expect.
She probably thinks her "nice little Christian girl" act and her statement is enough to put a person in jail for the next eight years of their life, but she's wrong. There had better be lots more evidence besides semen inside her; and when they don't find any other evidence, they are gonna question her about a hundred times and each time she tells the story, it had better be an exact copy of the one she told before. Also, her
general social activities are gonna go under the magnifying glass, too. Some States prevent using other boyfriends against a rape victim - it depends on the State, but
for sure your brothers lawyer will know what to do to get around that. There are many ways to show someone is not the "saint" they pretend to be, without actual sexual
history coming into it.
I cannot stress enough how important it is for your brother to get a lawyer, be completely honest with the lawyer, and keep his mouth SHUT SHUT SHUT.
AND FOR YOU TO KEEP YOUR MOUTH SHUT, EVEN TO YOUR CLOSEST FRIEND. If you never listen to any other advice in your entire life, please listen to this and keep your mouths shut.

Get a lawyer and pray for the truth to be exposed...Don't blame all Christians because someone may or may not be lying...and maybe someone should let police know she was dating your cousin..

It's not like the technology to prove whether it was your brother or not doesn't exist. It won't prove whether it was rape or not. Still don't see what it has to do with christianity.
