We are still married, but in the process of divorcing. He filed married/ separately for 2006 and someone told me that because I am still legally married to him, I can get a copy of the tax return he filed for 2006 just by knowing his social security number. The reason I even care is that he's working under the table, trying to avoid paying child support, and not responding to any of the divorce papers, making it difficult for me/ my lawyer to proceed with things. Does anyone know how I can obtain access to his tax records? Is it even possible?

Sorry, but if he filed a separate return then you have no legal entitlement to a copy of his return.
However, your attorney could subpoena a copy from him. He would then have to either provide the copy or appear in court and show cause why he should not be compelled by the court to supply the copy.
Your attorney is fully aware of the procedure and should have explained it all to you already. If your attorney doesn't know how to handle this type of situation, get one who knows what they are doing.

Because he filed as married filing separately last year you could not legally get a copy of his tax return without a court order. I would think though that you should be able to get that through the courts as part of the divorce process.

You can't legally get a copy - only could if you were on the return, with a joint filing.
A court could order him to product a copy. But if he's lying already, no way to be sure that what he produces is a true copy.

All you need to do is contact the IRS and ask them to send you a copy of the return.
