The situation is the following and I would appreciate any good support. An unfitted mother recently gave me her child with papers and everything stating it. What would be my step in order to get him a visa, since I did not use an adoption agency but the child simply given to me.

Contact INS to see what papers you need for border crossing
Let the American Consulate recommend an adoption attorney for you, since some are scam artists.
Contact your local public childwelfare agency in your state to see what paperwork and contact information tehy need, shot records, medical records.
You need paperwork that terminates the mother's rights, so she can't change her mind. And a birth certificate with you as the now mother.

You need to contact a lawyer right away, and even then it may be impossible to obtain a Visa for this child. At the very least, it is going to be a very difficult process.

Unless you followed the law in both the US and Mexico, then the child is not your adopted child. Since you do not have an orphan Visa, I am assuming you did not go through this process. Just having papers does not make the child yours (legally)-perhaps it would be adequate if you wanted to stay in Mexico with the child, but that is not the case for bringing him here.

Again, consult a lawyer. I am not that familiar with the adoption process for Mexico, but you will most likely have to backtrack and complete that process-homestudy, etc.-if that is even a legal option in Mexico (to have a non-relative child adopted privately rather than through an agency).

I wish you and the child the best!

I'm not sure what the relinquishment requirements for Mexico are, but they will have to be met before USCIS (U.S. Citizenship and Immigration Services) will give your child a Visa and the child will have to meet the USCIS definition of an orphan. This could be very difficult or nearly impossible. I hope you have a way to be in contact with the birthmother and probably the birthfather also, because I'm sure they will be needed further to complete this process if it will be possible for you to adopt this child. You definitely do need a lawyer who is familiar with intercountry adoption.

Careful, what kind of papers have she given you? are you absolutely sure that the baby was hers? It is illegal to give a baby like that in Mexico, you can be accused of kidnapping, you are already in serious problems, the adoptions in Mexico are made through orphanages and the DIF the government office in charge of family issues. A mother cannot give you a baby like that even if she doesn´t have money cos then first the baby has to be placed with relatives who can take care about him, if this is not possible then he can be taken for adoption. what you are doing is illegal and the laws are extremely severe about that, I know many people in the US think that Mexico doesn´t have laws, but we have. And those are more sever in Naive people who thought was helping.

I don't know if you'll be able to get him a visa without major red tape. Adoptions in Mexico can be extremely complicated.

Contact the embassy or consulate and see if they can help you. Go to:
http://usembassy.state.gov/
to find the embassy to contact.

You might also be able to go to the Mexican Embassy here in the US
http://portal.sre.gob.mx/usa/
to find out more information about how to proceed.

You should also go to the State Department's website on Mexican adoptions at:
http://travel.state.gov/family/adoption/country/country_419.html
so you can read up on the policies and procedures.

I'm betting that you can at least get some additional information & some more leads on where to turn using these resources.

You're going to have a legal nightmare. Start with hiring an immigration attorney in the US and find out the laws regarding adoption. You will also need to follow whatever rules Mexico has.

You must contact an adoption attorney in Mexico in order for them to file the papers necessary to adopt him. It may or may not work, but legally, it is the only way.

Look here for some listed adoption and family law attorneys in Mexico:

WOW. Get a lawyer IMMEDIATELY! Were these papers notarized? Documented? Translated? Witnessed? You could get into real trouble with a child who's not your own. Talk to a lawyer in the morning, don't wait!
