i am petitioned under the unmarried sons/daughter over 21 category. he filed it on dec. 2006. my father is an immigrant.

You may apply for a US student visa and, if you can convince the interviewing officer that you are a serious student and fully intend to complete the course of study, the visa may be granted even though you intend to immigrate eventually, and even though a student visa is a nonimmigrant visa. Getting a nonimmigrant visa - especially for study - while waiting for an immigrant visa is called "dual intent."

yes, you can still apply for a student visa. i think that you will be able to get this sooner than waiting for the petition. but specify in your application that you are being petitioned by your immigrant father.

Yes, but you'll still have to fully qualify for the student visa and pay tuition and fees based on the foreign student rate. It's incredibly expensive.
