This is from About.com. Please note in the last paragraph "explanations" the ban is against "oral" and "anal". Most likely the intent would be if one party was not a willing participant or under 16. I did not find "position" mentioned nor the word "missionary".

I did read an article years ago about strange laws mentioning that Texas had a law stating any position other than missionary was illegal. The same article pointed out a law in San Francisco that required your elephant be on a leash while you take it for a walk. The latter going back tp the Gold Rush era.

Article 125—Sodomy
Text.

“(a) Any person subject to this chapter who engages in unnatural carnal copulation with another person of the same or opposite sex or with an animal is guilty of sodomy. Penetration, however slight, is sufficient
to complete the offense.

(b) Any person found guilty of sodomy shall by punished as a court-martial may direct.”

Elements.

(1) That the accused engaged in unnatural carnal copulation with a certain other person or with an animal. (Note: Add either or both of the following elements, if applicable)

(2) That the act was done with a child under the age of 16.

(3) That the act was done by force and without the consent of the other person.

Explanation.

It is unnatural carnal copulation for a person to take into that person’s mouth or anus the sexual organ of another person or of an animal; or to place that person’s sexual organ in the mouth or anus of another person or of an animal; or to have carnal copulation in any opening of the body, except the sexual parts, with another person; or to have carnal copulation with an animal.

No it is not against the UCMJ to have sex in a position other than missionary. The people that say that it is are wrong. The UCMJ further defines unnatural carnal copulation. It says, in short, anything other than penis to vagina is unnatural carnal copulation. It doesn't say a thing about what position someone has sex in.

The explanation from the UCMJ Article 125 Sodomy: "Explanation. It is unnatural carnal copulation for a person to take into that person’s mouth or anus the sexual organ of another person or of an animal; or to place that person’s sexual organ in the mouth or anus of another person or of an animal; or to have carnal copulation in any opening of the body, except the sexual parts, with another person; or to have carnal copulation with an animal."

Thats what the law says.

This is total B.S. and has been around for a long time. The only article regarding sex is article 125 and states:

ART. 125. SODOMY
(a) Any person subject to this chapter who engages in unnatural carnal copulation with another person of the same or opposite sex or with an animal is guilty of sodomy. Penetration , however slight, is sufficient to complete the offense.
(b) Any person found guilty of sodomy shall be punished as a court-martial may direct.

It says nothing about positions...I'm a retired Master Chief and was a Master-at-Arms for six years.

There aren't any sexual positions listed in the Uniform Code of Military Justice, where all article 15's and courts martials originate from. The only restriction is that homosexuality is against the regulations, and that might change at any time. The rest of the stories that you've been told, are just that...stories.

When my boyfriend told me this after one of his weekend drills, I thought it was funny.
The only way you'd get in trouble is if someone told on you. And I doubt anyone tells upper command that someone is having sex in any other position besides missionary, especially since I am sure that every single person who is sexually active an in the military has broken that law.

Any position outside missionary is considered sodomy under the UCMJ and they can try you for it. However, I've never heard of it being done. At most, they'd probably strip you of a stripe, take away some of your pay for a week or two, or give you extra duty. It would probably never be done unless attached to another charge like adultery (also against the UCMJ)

Outside the missionary is difficult...inside of a bunker would be ok...maybe in a missile silo...how ironic

But upside down in the shower is the way to go

Possibly. There's Anti-Sodomy laws in most American states, too... but I do not think anyone has ever been charged with doing anything illegal. My best guess is that those archaic restrictions were probably put in place to prevent gays from entering the military.

Strictly according to the UCMJ (Uniform Code of Military Justice), it is against the regulations to have sexual relations in any position outside of missionary. It's also against the UCMJ to give/recieve BJs and have anal sex, both of which violate the Sodomy article of the UCMJ (yes...they actually have an article all about sodomy).

However...it's highly unlikely someone is going to put you on report because you and your significant other did it doggy style the night before.

yes it is against regulations to have sex out side of the missionary position,, but the only time i have seen it come up is in a court martial involving, RAPE,SEXUAL ASSAULT, or ADULTERY in which case they can and will use every article of the UCMJ they can get to stick against you.
