Regardless of who breaks the engagement, the woman is to return the ring. Despite what people say about "why would you keep something that reminds you of a failed relationship?" she's legally obligated to do so.
The ring is a gift that's given with the contingency of a promise. If the promise is broken, the giver of the gift can reclaim it. This is always been a sticking point with a lot of people, but it can and will (and has!) held up in court.

The engagement ring is a promise to marry. If the engagement was broken, then the ring must be returned because there is no more promise to marry.
Personally, I don't see why the lady would want to keep the ring if she was the one to break the engagement.

If the woman makes the decision, she should return the engagement ring. If the man does, I think she should be able to keep the ring-although I personally, would try to get rid of it.
Check the laws of the state-some say that the woman is obligated to give the ring back-whether it was her or his decision.

accepting the ring implies the 2 are to be married (almost a contractual agreement)...breaking off the engagement should have the ring go back too- the ring is a promise of marriage, no marriage= no ring

The guy takes it back, no matter who broke up with who.
The ring is a promise to marry. If you do not marry, the promise is broken and ring returns to the one who bought it.
Now, the guy does have the choice to let the girl keep the ring, but it is up to HIM.

The only reason you would keep the ring is if he wanted you too. Of course you always try to return it to him the moment you break it off. You don't want that memory of the almost wedding do you? Return it unless he insist for you to keep it.
