My husband was denied legal representation, he was also denied a request for discharge. Due to a chain of incidents, he has lost his trust and faith in the Department of the Navy and wishes to get out. They are setting him up for failure. A lot of favoritism aboard his ship has occurred as well as harassment and degrading remarks. He is on deployment. I am desperately seeking help, advice and any information you could provide me.

I know I haven't provided enough information. I would appreciate it if people would not be so harsh. I am entirely new to this whole military and it's laws. When my husband and I were married he was shipped out soon after. I am doing my best to learn as much as I can. I realize that he did sign a contract. And he is not stupid either and knows that. He had requested legal representation several times and they had told him that he "could not have one". They told him that they will make damn sure that he will not be able to be employed in the future. What happened was he was being threatened by another sailor aboard ship. When he reported this to his chief, the chief did nothing about it. And so a fight commenced in which my husband was defending himself. But they are tacking the entire blame on him, because the other guy is a "favorite".

Please in no way get us wrong. He is very proud of what he does and enjoys what he does but not at the expense that he is being given. I myself am in doubt of the professionalism of this organization. There have been several incidents where both of us were given wrong information and pointed in the wrong directions. Therefore, I have also lost my trust. It seems to me based upon my experience so far as a spouse, that nobody seems to care to double check their information before giving it out. Due to all the harassment that he is receiving, he feels that his working environment has now become hostile. The treatment that he has been receiving is unacceptable. I can understand if he was still in boot camp, but he is not. His evals are impeccable and his test scores are among the highest in his department.

denied legal representation for what? if he received an Article 15(Captain's Mast) he could have requested a Court Martial instead, and they are required to give it to him.. BUT not until he returns from deployment.

additionally, you can't just ask to be released from your contract. you must have viable reasons why.. medically unfit , for instance, or severe financial hardship, or a death in the immediate family. you can;t get out just cuz you don't like your duty station.

there is nothing that YOU can do, this is HIS fight. if he wishes to make a complain to the IG, he better make damn sure he has his facts straight and can prove harassment

Legal representation for what? Did he face non-judicial punishment because of some infraction? If so, he could have denied an appearance at Captain's Mast and requested a special court-martial instead. That would ensure him an attorney.
What is the reason he's requesting a discharge? Because he doesn't like it? Sorry, He signed the contract to do his time in the service.

Without more information this is hard to assist with.

You mentioned he was aboard a ship. While aborad a vessel a soldier -does not have the right to appeal an Article 15- . I suspect something along this nature because you mentioned he wanted a discharge.

However, there is nothing you can do per sae, its up to him to contact his own Jag.

Ok I think I am tracking , is he being charged with something? I will explain by saying my daughter who is now 16 was in a fight this past March, I had tried to make the mps aware we were getting threatening phone calls at all times of the night , reported her phone call as harrassing to my phone company and informed her school of what was going on ( due to this child being involved with active known gang members on and off post), now with all that being said my daughter was attacked when she got off the bus , because my daughter fought her back (which she better have) the Board ( yes we had to appear in fron to f a military board) didnt care that she was defending herself our about past threats which were days prior to them fighting , it was the fact she hit her period..
She had a number events as far as her punishment that she had to complete , which I understood , but I stand firm behind my children I tell them if someone hits you , you better fight back... though the base has rules, and I understand that also.
My suggestion to is if he is being charged for fighting on base/ ship with a criminal charge , and you have proof ( phone messages records ) he was being threaten, I would consult an off base lawyer.. criminal one.

Different laws apply in the military...
If he did something they deem wrong he has to suffer the consequesces...then they will discahrge him when they want.
probably with a undisirable or dishonerable discharge.
He sign up he should of know these things going in.
By the way thank him for serving our country!
