Ask her point blank where she prefers to live and then let it rest no matter where it is . She is old enough to know by now . Don't force a big girl like that just because your nose is out of joint and you are mad at him. It will not work , trust me I speak from personal experience . I was ten at the time . I hated my father all my life because he spirited me away .
In case she is undecided keep her with you for a few weeks and then see how it goes .
What makes you think you have legal custody when you never went to court . Very confusing .

if you have custody why has your daughter been living with her father since she was 5?get an emergency custody hearing or talk to your lawyer, you do not have to give her back to him,the cops cannot make you...that's a domestic thing.the court might frown on him taking her out of state....but he also may frown on a mom that let her daughter live with him for so long, and now wants her back.what ever is in the best interest of the child...now....is that living with you all of a sudden, after all this time,or is it better to stay with her dad, that has taken care of her all this time?

Call your family divorce lawyer and file for full custody. Make sure you put into the paper work that he cannot take her out of state.

Legal system. At least find out your options. Some firms have sliding scales, so you can save money. But without knowing what you can legally do, it's impossible to know what you're able to do and how to protect yourself. If he lies that much, you need to protect yourself and your daughter.

Tell him you have custody and he's not taking her across state lines so try it and you'll flatten all the tires on his car and ruin his engine.
