I went to an average (not pricey) restaurant for dinner with 3 other people. I paid with a credit card. On the slip, I added 14% tip. At the time, I didn't know how much % tip I included, but I knew the service had not been good. They screwed up my father's order, almost gave me the wrong plate until a table across the room hollered at the waiter since they recognized it as their order, took a long time to bring back a to-go box, and never actually gave us the bill after we had to ask for it. So I actually walked up to the front register (although I don't think they check-out patrons that way normally) to run my credit card. I wrote an amount on the tip line, the grand total, and signed. When I checked my bank statement, I find they over charged me by $2. I don't understand this, other than it seems the new tip amount would be 20%. I didn't see any signs posting this service amount. If they require 20% tip, shouldn't they just add it to original bill so I know?

While all the other details are interesting, you may be getting off track.
Call the restaurant and let them know they overcharged you 2 bucks. Say that you would not really even bring it up, except for the fact it was one of a number of mistakes that happened. They can credit you back the amount.
If they wont do it then file a dispute with the credit card company. Look at the back of your statement, you have to do it in WRITING. Not email, texting, phoning, semaphore, etc.
If you have your reciept copy it and send with the note.
You should get a credit.

No, it is not legal to change your tip amount. I agree you should call the restaurant mgr. If this does not work , dispute it in writing with your credit card company. Even though it is only $2, your server may be altering several other customer slips. I would definately stand up for what is right and mgmt needs to be alerted. The only time a restaurant can add a gratuity to your check is if it states it on the menu and this is normally for large parties. This would be on your total check before you sign. Good luck.

I used to be in the restaurant business in NY and this came up. If i remember correctly, If you pay by credit card it is the the credit card company adds 20% on the bill - to hold funds for an anticipated tip. When the actual total of the( check with or without a tip) is batched through and processed
the total should ultimately reflect what you had left.I guess they do this to make sure the total is covered since charging in a restaurant it is a two step process ( pre tip and post tip totals can differ.)

This happened to a friend of mine, he went to the bank and disputed the charges. Do you have a copy of the receipt showing what you signed for? If not the bank should have access to that info. Being that it's only $2 I don't think it would be that big of a deal to start a whole investigation into, however I do understand it is the principle, and I would be quite teed off it if happened to me.

No its not illegal, especially if its for a large party and the menu states the % of tip that will be added on for the price of the bill, example u and 10 friends go to a 5star resturant and its all on one check, you being a ****** dont like ur server because he use to bang ur girl, u leave nothing. YES they can put the tip on the bill.

no,,,its NOT legal to add to a signed credit card slip. call your credit card company to get it amended. if it is stated somewhere in the place or on the menu that they add gratuity it has to be added BEFORE you sign. no one can alter a credit card amount after its been signed. two bucks is two bucks. get it back.

No it is not illegal, but you can refuse to pay the gratuity, just call the restaurant and tell them. But it is only $2, so you may have added wrong and then they adjust it.

IF YOU SIGNED FOR 35.00 INCLUDING TIP AND THEY CHARGE YOU 35.01 THATS ILLEGAL ....YOU GAVE THEM PERMISSION FOR A CERTAIN AMOUNT BY SIGNING ANYTHING MORE THAN THAT AMOUT IS STOLEN DISPUTE IT!!!
