My daughters ex got custody of my grandson , both agreed so no trash was talked. He had custody of him for 4 years, we saw him rarely ,then they (Wife) started bringing him around more ,for us to keep, one day they showed up ,he had been busted for drugs ,he got 12 years, this was his 3 felony (TEXAS).They left child with us (Maternal Grandmother, Mother ),While he was in jail Wife got on meth was strung out bad ,came to house one day and demandedchild, when mother said no they tried to take him , big fight ,my daughter tried to stop it ,and they ran over her head, Now she cant live alone (Like a 10 year old, but she knows her children) #1, Does he still have custody ?( gave me power of attorney) #2 . Can he come and demand child ? Will i have to give him up? #3. Since he has lived with us 2 years,Does mother have custody now? even though he had to give me P.O.A Due to the assault? What can i do ?

I have to take care of my daughter and the three kids ,since she is unable to care for herself or children since accident.

I would get a lawyer and get some real advice Move fast as the one who gets to court first generally prevails providing you have a valid argument.

I would have called the cops. She doesn't have any custodial rights anyway, and usually a 3 time loser is not going to have custody of a kid! What judge was stupid enough to pull this one off!

You should have sought custody when he was busted and went to jail!

His 2nd on drugs is neglect if she takes him as she can't care for herself, much less the kid!

How does hew have custody. An agreement between them? If so he has squat, and if he tries to get custody, he's going to lose!

Mother has custody as you have the child, unless something else exists! If it does not, I would get custody in the courts.

If you are the grandmother, where is the mother?

No they can't demand the child unless they are legal custodians!

You can seek guardianship!

Don't let this go on like this as it will be a constant battle. Get legal rights to the child and given his history and the new ones drug abuse, and he is a drug addict as well, they should NOT have custody of this child! Period!
