We have been together almost a year, both in our forties, defintely want to be together. We know there are several avenues open to us but I am wondering if anyone has any experience with either the fiance visa, or being sponsored by a family member (he has two sisters who live in the states.) Which one is more of a sure thing? We don't want him to get denied because of quotas, then be unable to visit for a year!

The priority date for sibling visa (F-4) is 01 Nov 96. This date means that they are now processing petitions filed on or before first of Nov 1996. So the delay between filing and start of processing is now just under 11 years.

K visa and CR visa are not subject to quota so they are processed and issued immediately.

If you are US citizen you can apply for K-1 fiance. If Resident Alien, then you need to get married first and apply for K-3 or CR-1. For Philippines where my fiancee is coming from, these take 6 to 12 months (closer to 6 right now). You'll find timelines for Canadians at Visa Journey. Those timelines will give you a good idea of how long this process will be for you.

As has been stated already, the fiance visa is far far faster then than the immigrant visa via sibling sponsorship.

Within the above guide are links to various resources pertaining to each section as well links to great guides that will answer many of your questions.

If by chance your fiance is at least 50% Aboriginal Canadian, then the choice is even simpler. See http://www.familybasedimmigration.com/forum/showthread.php?t=1150

You'll knock about 7 years off the process by using a fiance visa. He should get it in 6 to 8 months.

K1 visa or if you get married a k3 visa, the K1 visa is your best way to go and then you will have to marry within 90 days when he arrives.

(You will need to do this)

G-325A for both of you
Passport pictures 2X2 two of each of you
Petitioners Birth Certificate
Proof of relationship and meeting like hotel and airline receipts, phone bills, photocopy of passport stamps when you met visited him

While the U.S. citizen spouse is not subject to quota restrictions, the fiancee visa is faster by far. Go for it!
