Can this person go as a tourist as a passenger and not a driver?

Yes, you can get in as the charge is more than 5 years old. But it is better if you look into it a bit deeper and follow the procedure. Because the charge is still less than 10 years old they need to apply for rehabilitation. I would contact the Canadian Embassy or Consulate and look into it further, as you may not want to head to the border and be turned around there because you did it wrong.

If they are driving or not is not relevant. It is that the committed a crime that is of concern.

DUI is taken very seriously in Canada, better do as JuanB suggests.

If the conviction was a felony then NO they can not go to Canada
