The guy who hit them tells the cop he smelled alcohol. They get busted for DUI. It was their first offense. Three years have passed without a repeat offense. Their insurance company never found out. Now they want to shop for cheaper insurance.

Will any insurance company they're considering still try to financially rape them for a policy three years after the fact ?

Any conviction for any accident whether it is DUI or a fender bender will stay on your driving record in most jurisdictions for a period of 5 years. If your insuance company did not check your driving record makes no difference since although you get those points back after 3 years but it is still on your record.

If the other insurance company paid out damages to the party who was rear ended then it will appear on their company records showing you as the at fault party as most insurance companies now post all claims to a common system that most have access to.

So if three years has gone by, be prepared that your insurance company will probably check your record sooner or later and you will see an increase and perhaps be cancelled for non-disclosure of the incident.

If you approach a new insurance company they will immediately do a driving record and insurance record search and they will find out immediately and if you do not declare the DUI they will decline you and if they bind coverage and find out later they will cancel your insurance back to the inception date for non-disclosure.

My advice is stay where you are for at least 3 more years and hope your current company doesn't check, don't give them any cause to do so and don't drink and drive.....it's a dumb *** thing to do. You may kill yourself and take an innocent person or child with you! ( Oh I forgot it was a friend and not you! )

Yes. DUI stays on your record for at least 5 years. Most likely their insurance company hasn't run a DMV check on them recently. If they do, there's a good chance that they will be billed for the excess policy charges going back to the date of the conviction. The "fine print" on most auto policies requires the insured to notify the insurance company of any and all accidents and violations.

Unless they are 100% truthfull their insurance will be invalid, another accident and their fault would be fiancial disaster.
