My exs wages are being garnished but by the irs but he says he received a state refund

That would depend on what the issue was. If he owed federal tax and they have not levied the state, he would get a refund from the state.

Assuming that his wages are being attached for a tax debt, he would not likely see any state refunds. If his wages are being garnished for something other than taxes, child support, or a student loan then tax refunds cannot be touched.

not really ,any money owed to the IRS usually is taken by them on any state or federal refund so I'm very surprised the received a refund from the state but if he did it must have slipped passed someone.

STUDENT LOAN FROM THE DEPT OF EDUCATION IN ATLANTA GEORGIA IS THE CREDITOR AND CAN WE STILL GET A STATE REFUND AND NOT THE FEDERAL REFUND BECAUSE OF THE GARNISHMENT?
