Help me with false accusation of sexual offence?
I am new graduate with no job and money to hire a lawyer. But..............
I met a woman five weeks agoin her mid-30's?
We had a wonderful night having sex. After 4 days a detective( proved to be a real detective) called me and said that, she accused me of putting some kind of drug in her drink to make her have sex with me. Which is not true. Next morning, she kissed me and left me her phone number (I have her handwriting ). Since that last call the detective did not call me. I called him to make sure what is going on and gave him her handwriting photocopy. He said that they are still investigating the case. I do not know what to do. I am scared Help me. What should I do. Did anybody know how long it takes an investigation.

Ok, here's the deal. And you are not going to like it.

When you are a person of interest, or a suspect, the police officer's job is to find evidence to convict you.

The ONLY time you can trust a police officer in these situations is that when he says "anything you say can and will be used against you" he is telling the truth.

Notice -- he does not say: Anything you say will be written down. Or, anything you say will be investigated. Or, if it helps you, we will put it in the report.

Only, that what you say can and will be used against you.

What does this mean? It means that you should walk to the public defender's office and see if they will take your case while your are being investigated (it depends on the state, often you will not be accepted until you are charged).

But, the police are not your friends. The police are there to find and convict people. Period. Right now, you have a bull's eye on your back.

The most important thing to remember is, if you say nothing, it cannot be used against you, if you say ANYTHING, it will be used, but only if it can be used against you.

The vast majority of all defendants are convicted by their own words. Even when the words should help exonerate them, they are twisted with other evidence to show taht the defendant was either a liar or, perhaps, was tacitly admitting to something (for example, if you told the police that you had sex with the woman, that eliminates one element of rape. Now the only question is whether they have evidence that you may have had non-consensual sex)>

Why help them convict you, especially if you are innocent? See a lawyer, or legal aid, or the public defender's office. But unless you are accompanied by an attorney, and the attorney advises you to talk (which almost never happens), do not talk to the police about the woman or that night again.

I wouldn't be that concerned. I doubt if she has any blood evidence if what you say is factual, and if she does they should be able to tell how old it is by it's level!

You sure you are not being blackmailed?

I find it highly against protocol or good investigative techniques for a detective to call you on the phone and give you that information. They should have asked for you to come to the station, inform you of the allegations and have you write out a statement! This is for surprise and to trap you into a story, which you would be hard pressed to change!

I would hire a lawyer to protect your rights, and I wouldn't say a damn thing to anyone or provide any statement! I would refuse to talk to the police telling them you want to see your attorney. They have to stop any interrogation at that point. Do not take a lie detector test as they are not accurate and they certainly are not a judge or a jury! That would be the basis the police would use to charge you even though it is inadmissible in court due to unreliability. It doesn't measure a lie, it measures body reactions!

The police can take as long as they want to complete an investigation!

Do you have a lawyer? If not get one ASAP. That is the best answer. Do not wait for a lawyer to be assigned to you after you are charged. You do not want to make ANY more statements to the police without a lawyer there to protect you.

Typically, if someone is making a false accusation of sexual assault, something in the story will not quite fit and they will not pursue charges (unless you have a zealous DA and you are a rich kid on a lacrosse team)

I would think that her leaving you her phone number the day after would be a clear sign that she was not just assaulted. However, she could always claim she gave you the number beforehand (which would simply be a matter of he said/she said).

Im surprised that nothing has been found out after 4 weeks of your being contacted.

Start a list of questions.

Why the long delay?
Rape is a crime. How come you were not arrested? (investigators know they have a very weak case, you would be arrested otherwise).
What is the alleged drug?
Did she see a doctor?
What is her possible motive?
Did she have an organsm? Drugged women usually don't.
Did you talk during sex? After? Right before?


Make detailed notes of the events of that evening.
Trust your innocence. It sounds like a set-up.
Meet her again only in public places.
She could say that she wrote her number before you raped her.
Volunteer to take a poly.

PS, She does not like men.

Anything else that might help you.

My Lord, man..........you've asked this question 5 times on Y! Answers. Don't you think it's time to contact Legal Aid and get an appointment?

PS. An investigation goes on until.........there is an arrest, or the police conclude there was no basis for the complaint, or the statute of limitations is up (7 years in Illinois).

Well, looks like you met a lovely lady. If that is EXACTLY how it happened, then you have nothing to worry about. But, I have my doubts about your side of the story.
- Was a toxocology test ran?
- Did someone else slip her a some drugs in a failed date rape attempt?
- Does she has psychological problems?
- Does she have a grudge against you?
- Did you fail to call her, which pissed her off?
- Is this detective a private investigator or a law enforcement agent?

OK, you have already asked this question and had gotten good answers...time for you to get off the free forum and get some real advice from a laywer. If you are being charged with a crime you can get a lawyer for free (public defender). If you are not being charged...FORGET ABOUT IT.

All you can do is wait.

You have done what you can. Hopefully this woman will prove to be a wacko and you won't have to worry about it.

If you are charged with something a lawyer will be provided for you at no cost.

Keep a diary or log of every time you or a family member has contact with her in any way. List every threat exactly as stated with the time and date also. List every witness to the conversations. If legal in your state record every conversation with her and hopefully catch her on tape making the threats. Use a digital pocket tape recorder

i do not think you have to worry. They would test her for the drug which would come up negative. Plus she is of age to consent for sex.
