If a person's spouse cheated on them, which resulted in the marriage ending, and the two people living separately while filing for divorce, would it be considered adultery if the spouse who was cheated on had sex with another person? The marriage is already physically over, but not legally. I realize that it is still wrong to have sex outside of marriage, but I just wondered if God would consider this adultery or fornication.

It's adultery and fornication. It's fornication because it's sex outside of marriage, and it's adultery because it's a married person having sex outside of marriage.

If doesn't matter if you feel divorced in your heart. You're still not actually divorced, and sex outside of your marriage is wrong. Look at it another way: a lot of people feel married in their hearts before they're even engaged, but if they have sex before they're actually married, it's still fornication.

As with premarital sex, until the customs of the society in which one lives have been fulfilled that are associated with identifying a couple as legally divorced, God Himself considers you still married. So yes. However, Biblically, the only justification for divorce is if one spouse is a non-believer. Infidelity is not Biblical justification for divorce, so in God's eyes if you are both believers and get divorced because of adultery or any reason other than this, God still considers you married even though society may not. And it should be noted that the believer in an unequally yoked marriage is not permitted to file for divorce, only the unbelieving spouse can, but God will consider the marriage disolved if this happens. That's why marriage is the 2nd most important decision anyone will make in their lifetime.

When you as a Christian have intimate contact with another if you are truly in Christ you must realize that you are taking Christ with you to where ever you are.

If You were a wronged spouse, the marriage is terminated in Gods eyes when the adultery occured BUT YOU CAN CHOOSE TO forgive the adultery and continue to be married or you may choose to divorce.

The way Christ explained it you should refrain from any sexual contact ever again like wise you should not return to a spouse if you have disolved the marriage.

I am sure I am not qualified to explain all the ideas Christ gave to us with regards to marriage and divorce. When He spoke to these issues, He was infact if I am not mistaken speaking to immoral pharasees or religious leaders of the day that were always looking for loopholes in the law.

Sexual activity (if married) out side of a marriage is adultery. Sexual activity (if unmarried) is fornication. It falls under the catagory of immoral behavior. The immorality was based on the idea that sex usually produces a child, there was no contraceptive or real birth control at that time. The chances of impregnating a woman was more likely then than now. The immorality comes from creating children that would not be recognized by the father, children out of wedlock (very socially unacceptable).

In this day and age I'm not sure how to judge it, except to say, if you divorce a "Christian Marriage" on proper grounds, ie adultery, or physical violence, (there could be other reasons, but for scriptures sake we can use these two), you as the injured party should avoid sexual contact untill you are remarried. God is a big God, and forgives and restores much, best to try to heal the 1st marriage when ever possible.

If she's not married to the person that she just slept with, then that's fornication, as for adultery, it's really a condense matter, if the marriage was truly over then no, but if she didn't want it to be over then yes..., so yes fornication, mayb adultry, Jesus died for our sins, and I'm sure he will forgive you if you pray.

It would be considered both. Adultery because you are still legally married & fornication because it is pre marital sex (you are not married yet to the person you are having sex with).

Don't let your thoughts go back to the past too much.
If you think it is a SIN no matter adultery or fornification, just confess it and GOD will forgive you (as you believe).
Even If you think it is not a SIN, confess your other SINS, then he will forgive you again.
What better is to take it as a SIN for the safe side and confess it. In anycase you will be forgiven and blessed in the end.
One thing very sure is you will be put in court if you are caught out as a criminal of adultery, in spite of GOD's forgiveness.

adultery is any sex outside of marriage. It means if you are not married to the person you are having sex with it is adultery.

Yes it would be considered adultery because the divorce is not yet final. The bible urges its readers to obey all laws set by man as long as they do not interfere with obey Gods laws.

Marriage is honourable in all, and the bed undefiled; but whoremongers and adulterers God will judge.

If you have relations with someone you are not married to when you are still legally married to another, then yes that is adultery!
