My boss's husband was arrested; and is set to be deported back to Mexico. He came here when he was a BABY and has two small children with my boss.
Is there any way for him to get an extension of stay to be in the U.S.?
She would really like to know. Please, no answers about he deserves to go back. My boss loves him and so does his kids.

but I agree, he could have done something while he was here to become legal.
But no way in Hell does he deserve being deported. Try to get in contact with a lawyer who knows the stuff very well. Hope the best for her, good luck.

Are they married? That's the easiest way, but I'm guessing not or they and you would know that. Unless a Lawyer knows a way, like time spent here, time spent in a common-law marriage or relationship maybe, or maybe proving being a major provider for the children. If all other parties are American citizens seems there would be some way. An immigration lawyer of some type should know.

The problem is that the US is very Gung-Ho on deportation these days. Immigration is a big issue. Good luck

No one here has the authority or knowledge to give the correct answer to your question. If your boss is serious about taking care of this matter, it's high time that she consults an immigration lawyer and get some basics lined up. Sending some girl to get answer from this site just sounds very very strange.

Afraid not, no extension. Not his fault his parents did the wrong thing. Knowing this, he should have done something about it before he was found out. Sorry, but he will have to apply once he is back in Mexico and wait out the penalty time he will get.

She should see if she can sponsor him she should get an immigration lawyer and he should not sneak back while she tries to get him here legally. People sponsor their spouses all the time.

IF he came here as a baby, he should have had this all straightened out upon turning age 18. After age 18, you are responsible for your own actions. And his actions were illegal, and he knew it. Before he was 18, his parents were at fault, but after 18, this is his fault.

He did not deserve to go back when he was first turning 18, but after that, there is no excuse. Whatever bed he made, he will have to lie in it.

Please advise her to see an immigration attorney immediately. If she is here legally, she could petition for him if they are legally married. That is a long-term goal, though. For now I would call an attorney- LIKE NOW! Every minute can make a difference.

If he is co-owner of a business, depending upon what that business is, he may be able to get a visa for businesses to do business here. The children can't petition for their parent until they are 18, though.

See an attorney now!

Blame his parents if he's deported. Every illegal alien...all 20 million have their own story. Every criminal in the world is innocent, ask them!!!! But as was said...he knew he was illegal...when he became an adult, it became HIS responsibility...

If what you said is true...he will suffer the same as other families suffer because of crimes the parents commit. How many children do you think have lost parents that are now in prison due to crimes the parents they committed? Do you think they love their parents any less??

Is your boss a US citizen? then he shouldn't be able to be deported at this point.

Some time in life you have to except responsibility for your actions. He's been her since a baby .Why hasen't he complied.This means no taxs, Id fraud etc.Why did he get deported then?
