sell Jordan/Nike shoes off the street with out the license?

I mean I buy them cheap and sell them cheaper than retail.

That depends...are you selling them for less than retail? Are you selling a lot of merchandise? Or just the one pair of shoes?

If you are selling them as New and do not have a wholesale license with the manufacturer, it is a civil issue, but you may also be violating a local ordinance.

If they are NOT actually Nike and you are purporting them to be then it is a version of counterfeiting, and they are subject to seizure along with all gains (all the cash you are holding).

The criminal penalty is not so bad, but Nike WILL go after you civilly and take your home.

You have every right to resell your own property and charge whatever you want for it, but zoning laws in many areas may prohibit you from simply plopping down and setting up a table at the side of the street, or you may need a vendor's license. But as a practical matter, if you're just walking around carrying a bag full of shoes and offering them to passersby and not obstructing the sidewalk, I doubt any cop is going to bother you.

If you own the shoes (i..e. if they are not stolen), then the only issue is whether you are conforming to any local city/town ordinances for being a merchant.

Different cities and towns have different rules about what you are allowed to sell on the street, how permanent your "shop" can be, how many hours you can stay in one place, total volume of sales --- etc. Check with the local city/town hall.

Depends upon the ordinances of your city.

In the South , most of the "Southern" cities set up
around 1880 will let you hawk anything on the streets
if you live within the city limits. After all --
those cities were set up as alternative markets to favor
the new burgers.

You might want to check into a vendors permit at the courthouse, or call the police station.

the can give a ticket or warning to not sell on streets without licensce i dont see why theyd bother when crack dealers stand out there they dont do crap

yes, sales tax must be paid and that tax must be turned in to the state. you must also have a license, I'm sure, to sell goods.
