the police were called and we made a report. the problem is that we called my mom insurance today and they said that was excluded in her policy so they cant do anything. im afraid to call his insurance because im not covered in my moms insurance. is there anyway he can pay for my damages even though i wasnt insured. or should i just fix it myself to avoid problems

Technically you were commiting a crime by driving without insurance.... but, since you were not at fault and they'll never know what your moms policy looks like, unkless you tell them. If he is legally liable for the damages, they'll pay. I'd pursue it. The worst thing that could happen is they say no, we're not paying. Not a big deal. File the claim dude. Dont even bring your insurance up, it's a non factor.

Oh..... and get some insurance! or stop driving!

Did you get his insurance information at the time of the collision? Were the police called? If so, yes, you will be covered. If not, good luck collecting. Why are you driving without insurance? You make my rates go up. Where I live in Arkansas, both vehicle owners have to show proof of insurance any time the police are called.

If the police were called he should have been ticketed and his insurance would be obligated to pay for the damages. If they don't then your Mom's insurance company is going to say we aren't paying because he wasn't covered.

It doesnt matter wheter or not you have insurance. The at fault party is liable therefore his insurance would cover you damages if there is coverage for the claim.

Hopefully you got the police to come and investigate, and that they gave him a ticket. If so, the it should be no problem getting his insurance carrier to pay everything.

If you didn't (or they didn't), it could get very dicey, indeed.
