My husband died 6 years ago and I remarried 2 months ago , my kids are 8,10, and 15 years old. They all want to take my husbands name, how do I go about this and how much does it cost? I heard that you can just use it without doing anything ,is this legal?

it depends what state you live in, you need to get a family lawyer to file a motion for a name change, if your kids receive any ss from you recent husband than you may not want to do a full adoption but just a name change.. it vary's on cost depending on were you live..

Your husband doesn't have to adopt your children for them to change to his last name.
You can hire a paralegal or a company. There are forms to be filled out and filed with the court.
I don't know what the cost would be, but certainly less than going through an attorney.

It shouldn't be hard to do as your first husband is dead and you have remarried. However, I don't think it's going to be free. You would have to file paperwork to have their names legally changed. Which involves court appearances (fees) and potentially a lawyer.

You have to go to court and you and your new husband have to adopt them. I find it hard to believe that your kids at that age want to change their names. Be sure you aren't just projecting. My folks did this when I was 3 and at 54 I still resent it. Do they realize that their birth certificates will also change and it will be like their father never existed.

legally you can call yourself anything you want to, as long as its not for fraudulant purposes, ie obtaining a loan and reverting your name back and not paying it, here in the uk it costs £30, $60 to change your name by deed poll, that way you can have your "new" name on passports etc, you cannot if you just change it yourself

Look up on google "change last name" there are links to free forms you download and fill it, it's a PAIN though, they got to get new social security cards and then you got to change it with the school, their doctors, on other records, etc.
I think they should keep their real father's name, that is a shame for them to discard their father who is dead.

i do think so. thy say that you can Assam a name. but to do it in court its about 250.00 to 600.00 for one name change. see if you can and i know that you can find it on your p/c. and man its free. save THE MONEY. let your fingers do the walking. i am so sure that thy can do it. but now days with all the crap going on it may have changed . do the finger thing and you know .save the money thing.

he would have to adopt. in the u.s, adoption can start a $4000/child. the price can go up depending on the situation.
it wouldnt be legal for them to just use his last name.
