The whole Pakistan including Kashmir and other provinces actually are part of India. British people and our great politicians are making it confusing. The British created Pakistan, that time leaders of both the parts helped them to create this so called partition. And the present day politicians of both the countries are keeping the fight alive in the name of capturing area filled up with Ice with no people residing in it.

The general people of both the countries including the people of Kashmir do not bother much in which country those barren land belongs too.

YES.

However, there is some conflict about Kashmir. The Kashmir conflict refers to the territorial dispute between China, India, and Pakistan over the northwestern region of the Indian subcontinent. India, which claims the entire erstwhile Dogra Kingdom of Jammu and Kashmir, has control of approximately half the region including most of Jammu, Ladakh, Kashmir Valley and Siachen Glacier. India's claim is contested by Pakistan which controls a third of Kashmir. The Kashmiri region under Chinese control is known as Aksai Chin. In addition, China also controls the Trans-Karakoram Tract, also known as Shaksam Valley, which was ceded to it by Pakistan in 1963.

India has fought three wars with Pakistan: in 1947, 1965, and 1999 and one with China in 1962 over Kashmir. Since the 1990s, the Indian state of Jammu and Kashmir has been hit by confrontation between armed Islamic insurgents and the Armed Forces of India, which has resulted in thousands of deaths.

I really do not understand why people accuse the British of dividing India. Remember they did not come to India the country. They gradually took over the reigns of different regions from various rulers.
Through out history India as we see it now never existed. Different dynasties captured regions and brought them under their rule. However each region maintained its individuality in terms of culture, language, food habits etc.
It was the British who united Indian Sub continent into one country. We still have barriers of language etc within and amongst different state.
If we consider this then you know the answer.....
But if we acknowledge that the British united the country then yes Kashmir is a part of India.

Ask the Kashmirs . They've been dealt a tough hand. But it is up to them now who they want to align themselves with or if they want their own thing. There is no easy book on this, but I would bet If the people could all get together then they would be able to get a country of their own free from any other country's rule.
(wishful thinking)

to answer your question it is actually split. One part is controlled by India and the other is controlled by Pakistan.

The area known as "Jammu and Kashmir" is administered by India. The area known as Kashmir is administered by Pakistan. There is a small area ceded by Pakistan to China, but claimed by India. And another area held by China, claimed by India.

(how bout 10 points?)
