Actually, the answer to your question is no, there is a non-penguin that can't fly and swims. The Flightless Cormorant (Phalacrocorax harrisi) from the Galapagos Islands is a predator on marine fish, and cannot fly in the air. If you do a search on-line for the genus and species (Phalacrocorax harrisi), you'll find lots of additional information.

You might be interested to know that penguins and flightless cormorants actually can "fly" in the mechanical sense of the word. The movements that they make with their wings in the water are identical to the movements made by typical birds in the air. The only real difference is that the wings of penguins and the flightless cormorant are so small as to require a thicker medium to generate enough forces to propel them along (in this case water).

The penguins are now the only flightless swimmers but up until 1844 there was another, the Great Auk of the northern hemisphere. In fact the name "penguin" was first given to the Great Auk. It is now, unfortunately, extinct.

the ones that said ostrich are wrong. DC said swim but cannot fly. An ostrich can't fly, but it can't swim either. Swan is also wrong. They can swim, but they can also fly. Penguins are the only flightless birds that can swim.
