GMAC put it up for sale but nobody bid on it, now is the banks house, how long do we have till the bank can evict us! this is in California and also very important, we have lots of plants and palmtrees, can I pull those out to take?

Plants and trees not in movable pots are considered permanent fixtures and are to stay with the property. If the bank has actually taken deed to the property, eviction could come at any moment. You are now a renter, and I'd venture that GMAC doesn't want you for a tenant.

Call the trustee and ask (it's in the original paperwork).

My guess is that since the property is now owned by someone else and you don't have a lease you can be evicted with 3 days notice.

Another option might be to contact GMAC and asked them if they want to rent you the place at a low rate if you keep it up and assist in the sale (allowing it to be shown). They probably want you out but it's worth a try.

Eviction usually takes 90 days, the plants have to stay.

trees go with the property. You can't take them. sorry.
