My husband and his ex wife are fighting over how much child support we should send her we are in Oklahoma. He is now making around minimum wage working part time because of a health problem so I make most all of the money in our household. This is over one child and he spends about 6 nights per month here in our house.

Does she have a legal right to come after my income?

hi i live in ok and am in the exact same situation. here is what i was told.

if your husband is working, then it will go based off his income only.

if your husband is not working, she could hire a lawyer and sue for the money you gift him to live off of, basically minimum wage. most times it would cost her more than she would win, so whatever there. if he loses his job and has no income for a period of time, then he will still be liable by the original court for the amount and you should pay it to see to it that he doesn't fall behind.

but no they can not take into consideration your income to declare what he has to pay. never will it be your legal responsibility to provide for someone else's child.

also, oklahoma reports to the credit bureau, and uses license suspensions as a means to get money. i suggest you get this done thru the court system as soon as possible.

we waited a year, just paying her cash here and there, then when she went on welfare we were put thru the court system and showed a year behind and $2100 in arrears... dont let that happen.

I don't know about all states, but when determining how much the custodial parent gets in support, the total household income of both parties is generally considered.

At least in my case it was.

So I'd say yes its a factor in the amount to be paid.

But I don't know that they can legal come after your wages. Perhaps not your paycheck, but any joint tax returns, joint checking/savings accounts, etc.

she can't take your money, directly that is. however she could argue in court that since your boyfriend's living expenses are reduced he now has more money to give her and she could demand an increase to her child support payments. the way the courts and divorce laws are so heavily biased against males there's a good chance the courts would agree with her. the good part is that you two aren't married so that will make it lots more difficult for her to make that argument.

The second wife is always the loser. Especially if there are children from the first marriage. You are going to lose everything to this woman because you have come after the fact. Get a really good lawyer and fight her tooth and nail!

Nope. The only thing she can do is garnish his wages, if it comes down to that. Most states won't even verify if it's being garnished correctly once they've done the legwork to get the garnishment started.

No she can only come after him and it goes on how much he is or was making when child support was first filed.

Absolutely not. You are not financially responsible for his and her child.
