my son and 2 of his roomates damage a house that they renter while in college , now a year later the landlord has sent my wife and i a notice that he wants us to take care of the charges, we did not sign any paperwork and have had no prior notice of any kind of problem. we are low income and have no money. does anybody know are resonsiblity in this?

If your kid was under 18 then you have responsibility, but I would say for only 1/3 of the damage.

If your son was a minor, you have to pay the damages as he was not legally able to sign a contract. Then again, if he signed the contract/lease, the landlord should be in trouble for even allowing a minor to sign the lease. If I had the document, I'd be able to help you out better. Sorry, I just need a lot more info...i.e. have they attempted to contact your son, how much does your son owe, does he live with you, is he employed, have you spoken to an attorney, have you spoken to the landlord, when was the last date your son lived there, etc. Feel free to email me with the info.

It doesn't matter how old your son was, unless you signed the lease or other document, you are not liable. If your son was a minor and the landlord was dumb enough to let him lease the property, then the landlord cannot go after him. Minors cannot enter into contracts, and leases are contracts. If a person contracts with a minor, that person cannot enforce the contract with the minor.

If your son was still a minor at the time the alleged damage was done, you might be held responsible for 1/3 of the amount of damage. Otherwise, you are not responsible for something that your adult son did.

If your son is an adult (over 18) and you did not sign the lease, you are NOT liable for any of the damages.
