Ok so i have a 4yr old son (born in minnesota) that has my last name and his fathers last name (Marc Schneider Anders). Well, i would like to change my name legally and also his to something completley different since i'm applying for my US citizenship i do have the opinion to legally change my name. So his new name would be Marc Scott. Now my question is, with his father not living in the same state as my son and i ( we live in missouri and he lives in south dakota) could i go ahead and just change my sons name or would i have to get a approval from his father!? His dad and i have never been married or gone to court regarding custody or anything like that. I lived in minnesota with his dad and then moved away when my son was 1yr old and we've been in missouri ever since and i really want to change my and his last name. What would the legal procedures be for that?! Can i do something like that without his father?!

First of all, you should remove the names from the post. The proper place to effect a LEGAL name change is in Probate Court in general. If you apply for a name change for your son, there may or may not be a requirement that the father be involved. In general issues involving custody, support, etc the Court will definitely require notice to the father. In a name change, I suspect they would as well. That doesnt mean the court would not grant the name change. It just means the father may have the right to be heard on the matter.

Your son's age is going to work in your favor. If he were a bit older, the Court might have trouble changing his name because of the stigma it might cause in school, etc. You didnt say, but it seems as if the father is somewhat out of the picture. Chances are he will not oppose this, or even respond if notice is required. Without opposition from him, it should be a no brainer. If he DOES oppose it, I think it's an uphill battle for him to stop it.

Most states require permission of the child's father in order to change their name. Contact a local attorney to find out what the procedure is.

One of my customer has transferred the technical department to another office with company name change. Is this office legally allowed to receive information related to the previous or old company name?
