The actual answer is mid-way between never and 26 years. All modern copyrights expire 70 years after the death of the composer for USA and EU countries. There are some exceptions that take into account "first published" considerations.

I believe it is 26 years, and the original owner has the right to renew rather than let it lapse into public domain.

if its copyrighted it never becomes legal for you to take and claim as yours
