Yes, even if it's not in the file they can be called and asked their opinion as a worker. Or as far as the file goes, yes they can place warnings and termination notices in there.

The laws are very strict anymore as to what a previous employer may say to a prospective future employer. In today's sue-happy world, most employers will not give out anything, just specific facts such as starting and ending dates, and maybe reason for termination. Employers are afraid that the employee will come back and sue them.

There is no file that moves from employer to employer. However, when your new potential employer calls previous employers for a reference, you old employer can disclose whether you were a good/bad employee.

They can but may place themselves at risk of lawsuits.

The worst I've ever said to another perspective employer when they asked if I'd hire them back, "NO!"

That is usually enough said.

Even if an employee has committed theft, this cannot be mentioned, UNLESS the employee was prosecuted.

If you've done something wrong and written up maybe. But if you had a good relationship with HR, they might not mention it.
