Having eight horcruxes was accidental and Voldemort's mistake.
The flayed baby is either Voldemort or Voldemort's accidental horcrux.

There were only 7 Horcruxes & Voldemort was the main part of his soul, not a seperate Horcrux. Plus, Dumbledore didn't want Harry to know that he was a Horcrux until the very end anyway - he wanted Snape to tell him.
I think the writhing baby thing when Harry died was the part of Voldy's soul that had been attached to him & it was in utter misery because Voldemort feared death so much.

The easiest answer is that Voldemort didn't know Harry was a horcrux therefore...
Diary
Locket
ring
Hufflepuff Chalice
Nagini
Ravenclaw Crown (was a horcrux, destroyed in the fire)
Voldemort himself
7...

Yea remember dumbledore told harry that voldemort didn't mean to turn harry into a horcrux. Voldemort didn't even know that he did, it was an accident.
So there really were seven originally.

A piece of Voldemort's soul inside of himself broke off and took up residence in Harry, thus yes, making 8 Horcruxes.
The baby at the end was Voldemort, as I believe other people have pointed out. (The one that was inside Harry).

yes thats right there were eight pieces to voldemorts soul... Dumbledore tells Harry there are seven because he wasn't about to tell harry he needed to sacrifice himself before harry needed to know it. think about it... harry knows five of the horcruxes have been destroyed (th diary, the ring, the locket, the cup, and the crown) all that is left to do is kill nagini and then voldemort... therefore time to face voldemort... but if harry knows there is still another, without knowing it is he, he would't face voldemort till his task was complete.
if harry had known all along, that might have gotten in the way of his quest (kind of a distraction, don't you think?)

Voldemort made 7 horocruxes on purpose but accidentally made harry the 8th horocrux. I think dumbledore purposfully didint tell Harry this untill the last possible moment becuase he realized Harry had to grow up some before he was faced with the news that he would die. Harry had to willingly go to his death at the end for the whole plan to work. I think dumbledore didnt want to tell harry this until all the other horocruxes were gone so that Harry wouldnt giv e up and run away from death. Harry found out at the time he was ready to handle the information.

Harry was accidental. Obviously, Voldemort didn't know Harry was a Horcrux, or he wouldn't have tried to kill him as many times as he did, and certainly not the last time.

It could be explained that Voldemort only believed there to be 7 (he didn't know about Harry), and that Dumbledore either didn't know about Harry either, or didn't have the time to tell him before he died - or that the one still in Voldemort doesn't count as a split.
