If the president of the U.S is impeached, can he attend the trial?

I believe the president's entitled to.

I'm not sure he (or she) would.

I will have to look up what happened in Andrew Johnson's case. He was impeached, I know, for violating the Tenure of Office Act - which he certainly did violate. But he was acquitted by the Senate, by one vote. The Tenure of Office Act was later itself ruled unconstitutional, as an attempt by Congress to usurp presidential power.

I wonder whether the FISA law will suffer the same fate as that act.
