My sister got a car from a private car dealer and hasn't made ANY payments on it for about a year. She told me she got a letter in the mail the other day from the DMV that she needs to renew her tags. So a question that has me wondering is ... would the DMV still carry on with the normal procedure of notifying drivers if the car was reported stolen??

If the car was reported stolen, and your sister went in to get tags, if she is the only registered/legal owner, she would be asked about the stolen status, and the transaction would continue if the police dept(after the agent contacts them)can verify the stolen status is incorrect. If someone other than the registered/legal owner, the transaction would stop and no tags would be issued. Her failure to pay her car payments to the lender has no bearing on the tabs/tags, the lender must come after her for payments, and would not report the vehicle stolen because of her payment history. If you were pondering the thought of reporting her car stolen, when it is in fact, not stolen, you could be charged with providing false information.

The DMV has no powers over the situation. The Dealership cannot prevent her from getting plates except by repossessing the car. They cannot claim the car stolen because they gave her permission to drive it. She may wake up some day and find it gone though. Hope she is close to home if they get it during the day.

If the title was transferred to her originally (even with a lien holder) which is the normal thing to occur, then the DMV doesn't care whether payments are made. That's a legal issue for the lien holder to pursue.

A lien holder cannot report a vehicle stolen, they can only take you to court to repossess it and claim the money not paid.

Your sister can only report the car stolen the dealer can not!

No, they wouldn't.

Clearly the dealer messed up on this. I'd imagine one morning she'll wake up with the car repo'd. If I were her, I'd take the initiative to straighten this out.

WHY DON'T YOU JUST CALL YOUR LOCAL DMV OFFICE, THEY WILL BE ABLE TO ANSWER ANY AND ALL OF YOUR QUESTIONS AND AT THE SAME TIME YOU WILL BE GETTING THE CORRECT ANSWER TO YOUR QUESTION.
