My cousin got verbally assaulted, harrassed, and physically hit by an event organizer during an activities class , Plus, this happened right infront of every participant's eyes in the class.
It happened purely out of racial hatred.

My cousin got angry and felt humiliated and went back to retaliate couple of weeks later by pouring a bottle of urine all over that initiator's head.
Now that person threatens to sue my cousin for criminal offence?

Do you think that initiator has a case here ? even giving my cousin a misdemeanor criminal record ?

he went to an activities class(martial arts) not even expecting this to happen, and just stood there being harrassed, verbally assaulted and physically hit by the martial arts instructor( bullying) *explicitly* out of racial hatred reasons. and got humiliated out of everyone infront of the class.

It's is what it is, this is what happened.

The justice system is sometimes garbage sometimes garbage, if my cousin gets charged for crminal offence by that assh*le, then i think the law system is a joke.

Pouring urine on someones head is most definitely a crime.

Not necessarily but this tantamount to misdemeanor on his part by his action in pouring a bottle of urine over that initiator's head. Your cousin is liable for an offense in the law. Although this kind of offense could be settled by outside the court meaning the two parties involved, no need for the court to intervened.

It seems that you have no faith in the law, I wouldn't blame you for that some people does. If your cousin filed charges when he was bullied in the first place then this might give that instructor a fair warning that his action is unacceptable and unbecoming of a teacher. But the problem your cousin didnot do anything, instead he plan a revenge do the unwise act.

Could be sued for a life time of work for pouring urine on someone, Worse than name calling by all means. Plus you have the premeditation and planning for a crime for two weeks not a instant reaction from a dispute. Can you say dry cleaners?

The person who attacked your cousin could easily be brought up on charges for what he did, and it's not too late to see the State Attorney and make that happen.

Perhaps if you let this person know that you intend to do so, he might just get amnesia about the urine incident, and both sides could agree not to press charges. If not, yes your cousin could be arrested for what he did.

The act of pouring urine is a criminal offense which constitutes as malicious mischief or unjust vexation. Anyway, cite the previous acts of the other party and use it as a mitigating circumstance if applicable.
