I've been keeping up with the info on a family member who a little less than a year ago plead guilty to a DWI. Now, this family member was stopped for "Failure to Control Speed" (not 100% sure how this is different from a speeding ticket). Since the day of failure to control speed, her car has not been seen and now her case status reads "Case Pending Action". Because she was on probation, what kind of action might be taken against her? Could she go to jail? Would her probation time increase? What can she expect to happen?

She won't tell us a whole lot but we just want to make sure she is following the probation agreement.........

The phrase means that the case has not been dismissed and has not been resolved.

Whether the action is pending on behalf of the prosecutor or the defendant is unclear.

If she violated probation, then she may end up having to serve the remainder of her original sentence, in addition to any new penalties for that offense.

And "failure to control speed" is slightly different than speeding -- because speeding generally requires intent or knowledge of your current speed, while failure to control can result from intoxicted negligence.

That means that some part of the court system is working on her case. She is still in the process. Getting a new violation will not help her case, but I still doubt she would get any jail time at all.
