And by sheer numbers of millions of legal marriages by ministers, priest and etc. this makes it binding law. the courts always falls bact to a single prior case as president to win their present case, well wake up, we have millions of prior cases to fall back on, don't we ?

atheist.... To start with common law marrage is a modern term, and just a fancy name for living in sin because of convenience and not caring enuff for the other person to make a perminent commitment and was put into law to protect the naive.
Also pertaining to marriage... you have no documented fact that anyone was married older than the old testament accounts. and yes people can be married buy j.o.p. or ship captains or whoever,and it is done as a commitment to become one flesh and be faithful for life, and done in the presents of witnesses. You can deny this as being a religious ceremony if you want. you can call an apple an orange if you want, but its still an apple. All those marriages did was take what was easy for them and excude GOD , that doesn't change the fact that marraige is as from the beginning a religious ceremony.

Marriage is a concept begun by God. If people do not believe in God, they do not believe in the concept he put forth, so what difference does it make? If two gay people want to make it legally binding that their property be held jointly and that they have the right to inherit from one another etc., I say all well and good if that is what they choose. But, that is not a marriage and should not be considered as such. I won't argue about a civil union (as described above) but as a Christian, I can not just stand by and allow gay people to make a mockery of something that is of God. It doesnt matter to me what the law says or does not say...it is a matter of my relationship with and respect for my God.

Marriages came before Christianity. Celts and other Pagan religions allowed marriage for any love--not just to the opposite gender. You just have to look past all of the history that's been corrupted, destroyed, or changed signifigantly.
The concept of the Christian God is only a couple thousand years old--look back at the Mayans 6000 years, the Aztecs 8000 years, the Greeks, Romans, and every other race and group of people that lived long before the Bible was written or man knew of the Christian God.
So, compare 8000 years to 2000 years--a lot more marriages without that nasty thought that the only true love is between man and woman. What is right about saying that two people aren't in love unless they're the opposite sex?

No one is claiming that marriage is separate from religion. We only claim that religions do not have the exclusive rights to say what is or isn't a marriage. As an atheist man I can get married to an atheist woman by a justice of the peace and we can leave god out of it entirely. It is just as legitimate as any marriage performed by a preacher. Get it? Why do religious people feel that they have the right to say what is or isn't a marriage for people that are not members of their church? No one is forcing a minister or preacher to marry people that are gay. They can visit the JP just like people who are atheist. So it has nothing to do with you and your ilk. What gives you the right to say what can or cannot go on in someone's private life. That is the number one problem with religion. You damn people cannot live by your own rules and leave well enough alone. You feel you must force your inane beliefs on others!!!

Marriage existed before and outside Christianity, even Judaism. There's also a preCedent for polygamy, outlawed race mixing, arranged marriages, among other things. Civilization cannot advance until the people as a whole collectively remove their head from their rectum. There are better things to put there.

People can get married without religion or a church, therefore it can be separate from religion. People just choose to combine the two.
I got married in my backyard by a justice of the peace. There was no religious significance at all.

I have been married for 20 years, and I wasn't married in a church. My parents have been married for 41 years, and they were not married in a church.
People have been married by ships captains, JPs, and other officials for centuries. Church marriages are not the only historical marriages.

Up until recently, women were sold to their husbands in order to improve the family name. Up until recently, people of different races could not marry.
Are you honestly trying to say we should go back to selling our daughters for dowries and segregation?
Then why would you say that "tradition" is a good reason not to allow gay people to marry?
We've been wrong before. Why couldn't we be wrong again?

Well what about those people who are married and have no religion, their lives have nothing to do with religion at all. How would this statement relate to them? Wouldn't marriage be separate from religion in this regard?

common law marriages are chicken scratch, since some are too selfish to make a lifelong commitment. Just long enough to get what they want.
Man - woman marriage were ordained by God. All other "marriages" is a sham.
