Legally in the state of IL whether they are exempt or not exempt they woule receive o/t pay for all the hours worked over 40 in any given week. So the normal week this person would receive 76hours normal pay and four hours of overtime.

For the situation given this employee would receive 76hours normal pay and 8hours of overtime.

This is the way that the state of IL states I realize that each state is different. This also does not pertain to salaried employees.

Overtime is payable on a per-week basis.

In the first schedule, there are 4 hours of OT in week one.. In the second, there are 8 in week one.

A few states mandate OT over 8 hours in one workday. Check with state law on that aspect.
